Spanish Abstract: Los países, en procura de atender las convenciones internacionales y las recomendaciones de entidades como el GAFI, la CICAD y el GAFISUD, entre otras, dictaron medidas administrativas tendientes a prevenir el lavado de activos. Luego, estos comportamientos se erigieron en delitos. En Colombia se creó así el punible de omisión de control. En el presente trabajo se efectúa un estudio sobre esta normatividad, precisando cuál es la responsabilidad administrativa y penal de los funcionarios del sector financiero por infringir estas disposiciones, y se proponen algunas reformas en procura de una mayor eficacia de las mismas.

Una de las conductas que en la actualidad impacta en forma más negativa a los países la constituye el lavado de activos. La posibilidad que este comportamiento se realice con la participación de funcionarios del sector financiero dificulta su persecución y facilita el éxito de esta delincuencia, El presente libro realiza un detenido análisis de la forma como las legislaciones han venido regulando este comportamiento, en algunas ocasiones por vía administrativa, otras por conducto de los estatutos penales y, en no pocas ocasiones, como en el caso colombiano, combinando estas dos estrategias. La investigación se centra en el estudio del delito de omisión de control tipificado en el artículo 325 del Código Penal colombiano comentando sus orígenes, las modificaciones en diferentes normas, su estructura y eficacia, para concluir con una demoledora crítica que conduce al autor a proponer su eliminación, por tratarse, a su juicio, de un comportamiento propio del injusto de lavado de activos. A partir de esta consideración y utilizando la más moderna doctrina criminal de influencia alemana, se realiza un detallado estudio de los deberes a cargo de los accionistas, directores, administradores y funcionarios del sector bancario para la detección y prevención del lavado de activos y las consecuencias penales cuando estas obligaciones no se cumplen a cabalidad. El presente texto se constituye en una herramienta fundamental para los jueces, fiscales y abogados en el ejercicio de sus responsabilidades, al igual que para las personas vinculadas a la actividad financiera de su diario quehacer.

Despite broad international recognition of the criminalization of illicit enrichment, it has not been universally accepted as an anti-corruption measure. Instead, criminalization of illicit enrichment continues to generate extensive debate and controversy. Against this background, this volume aims to provide an analysis of how illicit enrichment works, and attempts to shed light on any contributions that it has made to the fight against corruption and the recovery of stolen assets. Rather than delving into the theoretical and academic debates around illicit enrichment, this study focuses primarily on the analysis of current practice, case law, and existing literature to offer a new perspective to the on-going discussions. More specifically, the volume addresses the legal framework upon which the concept of illicit enrichment rests, and the resulting policy implications of that legal framework. It also focuses on illicit enrichment as an anti-corruption mechanism, from its roots as a response to the problems inherent to prosecutions involving corruption, to an examination of elements and inchoate offenses relating to illicit enrichment under international conventions. It examines illicit enrichment jurisprudence in the global context. An extensive survey was carried out to determine the countries where the offense exists, what form it takes, how often it is used, and for countries where it doesn't, what other measures are used in its place. The authors neither recommend nor oppose the adoption of illicit enrichment provisions, but rather aim to assist jurisdictions considering such steps by highlighting key questions that might arise during implementation, including how the offense is defined and enforced domestically by States. Similarly, the authors do not endorse nor criticize any practice carried out by States in the implementation of the criminalization of illicit enrichment.
