La responsabilité pour faute a-t-elle vocation à s'appliquer dans les rapports entre parents ou alliés comme elle le ferait dans n'importe quel autre secteur de l'activité humaine ? Inversement, l'existence d'un lien familial est-elle une donnée de nature à infléchir le jeu des règles du droit de la responsabilité ? Au fil des développements, l'auteur s'efforce de démontrer que, si l'article 1382 du Code civil peut parfaitement recevoir application au sein du cercle familial, il n'est pas non plus possible de faire abstraction de la qualité des sujets de droit - ascendants, descendants, époux, partenaires pacsés, etc. Aussi, certaines règles du droit de la famille élèvent-elles des barrières au jeu de la responsabilité civile. Le constat est particulièrement manifeste en ce qui concerne l'incapacité d'exercice du mineur victime. De même, les règles de répartition des biens en régime de communauté peuvent altérer l'effectivité du droit à réparation de la victime. Malgré la pléthore d'études sur la tension tradition-modernité, rares sont les publications de langue française qui examinent cette dualité à partir de l'expérience des femmes issues de groupes minoritaires. Le présent ouvrage tente de combler ce vide à partir d'une question aussi simple qu'immense : en ce tournant de millénaire, comment s'exprime la tension tradition-modernité chez des femmes qu'une double référence à l'altérité et à l'infériorité de genre -- autochtones, francophones vivant en milieu minoritaire en migrantes des villes et des pays -- condamne à des particularismes ethniques, linguistiques ou culturels consubstantiels au statut de « traditionnelles opprimées ». Regroupant des chercheurs dont les intérêts et itinéraires illustrent la diversité et les convergences de la recherche féministe francophone, l'ouvrage explore les construits socioculturels qui orientent à la fois l'interprétation du monde et l'action sociale de ces trois groupes de femmes. Dans un contexte marqué par l'émergence/résurgence d'affirmations identitaires multiples, le terme tradition revêt des connotations antinomiques selon qu'il est utilisé comme prisme interprétatif de l'Autre (l'immigrante, la francophone, la femme pauvre), comme référence à des structures sociales patriarcales et oppressives, ou encore comme catalyseur d'un passé révolu qu'on cherche à réactualiser en réponse aux difficultés associées au monde moderne. Si chaque cas comporte une part de recyclage culturel, son contenu n'est jamais fixé une fois pour toutes, mais est porté, au contraire, par un effort de créativité syncrétique refusant les étiquettes stigmatisantes du modernisme, du passéisme et de l'infériorisation, y compris celle de populations « vulnérables ».
