La subsistencia del perjuicio a partir dela aplicación de la compensatio lucri cum damno y de la reparación integral es un trabajo de investigación que aborda uno de los temas más incomprendidos dentro del derecho de daños, y que aspira a enriquecer el debate que se presenta actualmente en el país respecto de la reparación integral de las víctimas. Consta de tres capítulos: en el primero, esquemáticamente, se explica el daño como elemento de la responsabilidad civil extracontractual, tanto en el ámbito público como en el privado, diferenciándolo de sus consecuencias, también denominadas perjuicios y relacionando la tipología de estos. En el segundo se aborda el tema de la subsistencia del perjuicio a la luz del concepto de indemnización y de los distintos criterios que se han planteado para admitir o no la concurrencia de varios beneficios económicos en cabeza de la víctima.Así mismo, se expone el tratamiento legal y jurisprudencial que se les ha dado a las diferentes fuentes de beneficios económicos que pueden surgir con ocasión de la ocurrencia de un daño. Y en el capítulo final se demuestra que la reparación de perjuicios no se agota en una indemnización económica, que si ésta se ha otorgado en vía administrativa, puede volverse a solicitar en vía judicial, y que ciertos perjuicios aún subsisten a pesar de haber sido objeto de indemnización ,pues no se han reparado integralmente.
