Il volume, ponendosi dalla prospettiva del diritto penale, intende offrire degli spunti di riflessione in riferimento all’intricato tema della tutela della salute dei soggetti sottoposti a limitazioni coattive della propria libertà personale. La premessa è quella di una nozione ampia di “luoghi di detenzione”, all’interno della quale ricondurre non solo il carcere, ma anche le residenze per l’esecuzione delle misure di sicurezza (REMS) e i centri di permanenza per i rimpatri (CPR), destinati al trattenimento degli stranieri irregolari. Ciascuna delle tre sezioni in cui si articola il volume fornisce anzitutto una ricostruzione del dato normativo di riferimento, evidenziando quella fuga dalla legalità che troppo spesso caratterizza l’esecuzione delle pene, delle misure di sicurezza personali e del trattenimento degli stranieri irregolari. Si è cercato poi di affrontare questioni specifiche e particolarmente problematiche come il c.d. carcere duro, il diritto di rifiutare le cure del soggetto in vinculis, la responsabilità del medico psichiatra nel nuovo sistema delle REMS. Un’attenzione particolare è stata infine riservata alla giurisprudenza della Corte europea dei diritti dell’uomo, vista la sempre più significativa influenza della stessa per una ridefinizione degli standard minimi di tutela all’interno dei luoghi di detenzione.

Il volume analizza i risvolti giuspubblicistici della nuova procedura di risoluzione stragiudiziale delle controversie da danno iatrogeno introdotta di recente dalla legge 8 marzo 2017 n. 24 (cosiddetta riforma Gelli-Bianco) nell’ordinamento giuridico italiano. In particolare ambisce a dimostrare che il diritto alla salute (art. 32 Cost.), in lettura congiunta con il diritto alla vita (art. 2 Cost.), tanto nella sua delimitazione costituzionale, quanto nella sua previsione sovranazionale, con particolare riferimento al diritto di autodeterminazione (tale da ricomprendere altresì le ipotesi applicative del biotestamento), può trovare concreta attuazione attraverso gli strumenti di ADR.
