Le 2 octobre 2021 l’arrêt Nikon fêtera ses vingt ans. Le 2 octobre 2001, la Cour de cassation consacrait pour le salarié le droit au respect de l’intimité de la vie privée « même au temps et au lieu de travail ». En vingt ans, les mutations technologiques que l’entreprise a connues se sont répercutées sur la relation de travail. Pour le salarié, ces répercussions s’opèrent, d’abord, sur la perception du travail ; elles se déploient, ensuite, au niveau de l’organisation du travail et affectent, enfin, les conditions de travail. Elles se traduisent par la remise en cause de la protection juridique de la personne au travail. Pour l’employeur, les solutions technologiques offrent des perceptives de performance renouvelées. Elles se traduisent également par une collecte massive de données à caractère personnel concernant le salarié, créant une asymétrie informationnelle et mettant en tension le droit à l’autodétermination informationnelle issu du droit à la protection des données. Face aux transformations du travail liées au contexte technologique, l’amélioration du cadre normatif garantissant l’effectivité des droits fondamentaux de la personne au travail s’impose comme un enjeu de justice sociale. À un premier niveau de réponse, pris sous l’angle des droits individuels, s’ajoute la dimension collective. Afin de permettre aux instances représentatives d’exercer pleinement leur fonction de contre-pouvoir, l’intégration de la question technologique dans le dialogue social est déterminante. En revanche, bien que de récentes réformes aient promu la négociation collective au rang d’instrument normatif idéal pour réguler les relations du travail, de tels enjeux en matière de protection de la personne au travail face à l’emprise des TIC justifient l’intervention du législateur.

At the beginning of the twenty-first century the term 'privacy' gained new prominence around the world, but in the legal arena it is still a concept in 'disarray'. Enclosing it within legal frameworks seems to be a particularly difficult task in the employment context, where encroachments upon privacy are not only potentially more frequent, but also, and most importantly, qualitatively different from those taking place in other areas of modern society. This book suggests that these problems can only be addressed by the development of a holistic approach to its protection, an approach that addresses the issue of not only contemporary regulation but also the conceptualization, adjudication, and common (public) perception of employees' privacy. The book draws on a comprehensive analysis of the conceptual as well as regulatory convergences and divergences between European, American and Canadian models of privacy protection, to reconsider the conceptual and normative foundations of the contemporary paradigm of employees' privacy and to elucidate the pillars of a holistic approach to the protection of right to privacy in employment.

The accession by the European Union to the European Convention on Human Rights (ECHR) has opened up new possibilities in terms of the constitutional recognition of fundamental rights in the EU. In the field of employment law it heralds a new procedure for workers and trade unions to challenge EU law against the background of the ECHR. In theoretical terms this means that EU law now goes beyond recognition of fundamental rights as mere general principles of EU law, making the ECHR the 'gold standard' for fundamental (social) rights. This publication of the Transnational Trade Union Rights Working Group focuses on the EU and the interplay between the Strasbourg case law and the case law of the Court of Justice of the European Union (CJEU), analysing the relevance of the ECHR for the protection of workers' rights and for the effective enjoyment of civil and political rights in the employment relation. Each chapter is written by a prominent European human rights expert and analyses the case law of the European Court of Human Rights (ECtHR), and also looks at the equivalent international labour standards within the Council of Europe (in particular the (Revised) European Social Charter), the International Labour Organization (ILO) (in particular the fundamental rights conventions) and the UN Covenants (in particular the International Covenant on Economic, Social and Cultural Rights) and the interpretation of these instruments by competent organs. The authors also analyse the ways in which the CJEU has acknowledged the respective ECHR articles as 'general principles' of EU law and asks whether the Lisbon Treaty will also warrant a reassessment of the way it has treated conflicts between these 'general principles' and the so-called 'fundamental freedoms'.

Par les technologies de l'information et de la communication, les liens juridiques, sociaux, économiques et organisationnels entre le salarié et l'employeur se sont modifiés. L'usage des technologies a des effets sur de nombreux aspects oudimensions du travail qui sont intimement liés à la personne même du salarié. Avec l'article 8 CEDH comme fil conducteur et source principale des réflexions, la thèse réaffirme que le droit du travail et celui des droits de l'homme sont intimementliés et que l'article 8 CEDH s'applique aux relations entre travailleur et employeur. A l'aide d'une approche comparative, l'auteur analyse le droit à la vie privée du salarié en droit européen, en droit français et en droit suisse en faisant apparaître lesdifférences et les lacunes de l'un ou de l'autre droit. La première partie pose les bases du droit à la vie privée du salarié (vie familiale, domicile, correspondance, protection des données). Le difficile équilibre entre les intérêts de l'entreprise à sauvegarder sa sécurité et celui du travailleur à préserver son intimité fait l'objet de l'analyse. La deuxième partie traite de la mise en oeuvre de la protection de la vie privée du salarié en passant par l'élaboration des normes, les types de régulation etl'application qui en est faite par les autorités de surveillance nationales et par les autres acteurs internes ou externes à l'entreprise. La thèse démontre, sur la base d'une analyse comparée, qu' une meilleure protection du droit fondamental à la vie privée du salarié peut être valablement mise en oeuvre par le biais d'un règlement interne à l'entreprise, si possible discuté et négocié entre les partenaires sociaux. L'objectif est de protéger le droit à la vie privée de l'employé, non seulement en théorie, mais surtout en pratique.
