In the countries of the global North, workplace democracy may be thought of as a thing of the past. Increasingly, working relations are regulated primarily by contract; workforces are fissured and fragmented. What are the consequences of this? How should we respond? Ruth Dukes and Wolfgang Streeck argue that the time is ripe to restate the principles of industrial democracy and citizenship for the post-industrial era. Considering developments within political economy, employment relations and labour law since the postwar decades, they trace the rise of globalization and the ‘dualization’ of labour markets – the emergence of a core and periphery of workers – and the progressive insulation of working relations from democratic governance. What these developments amount to, they argue, is an urgent need for political intervention to tame the new world of ‘gigging’ and other forms of highly precarious work. This, according to the authors, will require far-reaching institution-building designed to fill legal concepts such as ‘employment’ with political substance. This eloquent call for a reimagining and renewal of the institutional and material conditions of freedom of association and the reinvention of industrial democracy will be crucial reading for anyone interested in work in the twenty-first century.

The emergence of a 'labour market' in industrial societies implies not just greater competition and increased mobility of economic resources, but also the specific form of the work relationship which is described by the idea of wage labour and its legal expression, the contract of employment.This book examines the evolution of the contract of employment in Britain through a close investigation of changes in its juridical form during and since the industrial revolution. The initial conditions of industrialization and the subsequent growth of a particular type of welfare state are shownto have decisively shaped the evolutionary path of British labour and social security law. In particular, the authors argue that nature of the legal transition which accompanied industrialization in Britain cannot be adequately captured by the conventional idea of a movement from status to contract. What emerged from the industrial revolution was not a general model of the contract ofemployment, but rather a hierarchical conception of service, which originated in the Master and Servant Acts and was slowly assimilated into the common law. It was only as a result of the growing influence of collective bargaining and social legislation, and with the spread of large-scaleenterprises and of bureaucratic forms of organization, that the modern term 'employee' began to be applied to all wage and salary earners. The concept of the contract of employment which is familiar to modern labour lawyers is thus a much more recent phenomenon than has been widely supposed. Thishas important implications for conceptualizations of the modern labour market, and for the way in which current proposals to move 'beyond' the employment model, in the face of intensifying technological and institutional change, should be addressed.

Russias transition towards a market economy in the early 1990s called for new approaches to the regulation of employment relations in the post-Soviet period in order to strike a balance between employers interests and employees rights in changed conditions. The adoption of the Labour Code of the Russian Federation (LC RF) in 2001 contributed to solving the issue only partly, as, in reality, it was passed as a compromise between different political forces, and consists of both provisions which can be implemented in the new context of the market economy and restrictions inherited from the planned economy. The recent and ever-changing socio-economic conditions, and the increasing complexity of the employer-employee relationship, which is a result of both globalization and technological progress, required the further development of Russian employment legislation. This resulted in substantial amendments being made to the original LC RF in 2006, with the majority of its provisions being profoundly revised. Nevertheless, a thorough analysis of the changes currently under way shows that many aspects concerning employment relations have still not been addressed sufficiently. The papers collected in the present volume of the ADAPT Labour Studies Book Series consider the recent developments of the legal regulation of employment relations as well as some closely related aspects from a historical and comparative perspective, in order to provide some insights into these issues and to examine current challenges.
