First Published in 1999. This book provides a critical analysis of the widespread assumption that the formalisation and standardisation of property rights through state legislation has a positive impact on economic development. It is based on anthropological case studies of land and natural resource rights in Southeast Asia and Oceania. These suggest that the economic impact of the formalisation of property rights is not necessarily positive, certainly not for all categories of peoples. They also suggest that state reform of property rights do not necessarily eliminate the conditions of legal pluralism, but rather add new legal structures to an already complex constellation of property rights and duties. The point of departure for the empirical analyses of the central hypothesis examined in this book is that the practical significance of complex forms of property rights and related socio-economic practices cannot be usefully examined within formalistic, one-dimensional and normatively oriented legalistic or economic approaches. Instead, an anthropoligical approach to law is advocated in order to analyse the complicated, multi-dimensional relationships between property rights and economic development, and their embeddedness in social practice. Based on this approach, the contributions to this book show how different people and institutions attribute different meanings to the various components of property relationships, and how they use them as resources in their everyday lives and social struggles.

Do and Iyer examine the impact of land reform in Vietnam which gives households the power to exchange, transfer, lease, inherit, and mortgage their land-use rights. The authors expect this change to increase the incentives as well as the ability to undertake long-term investments on the part of households. Their difference-in-differences estimation strategy takes advantage of the variation across provinces in the issuance of land-use certificates needed to enforce these rights. The results indicate that the additional land rights led to significant increases in the share of total area devoted to multi-year crops, as well as some increase in irrigation investment. These effects are stronger in areas that felt the impact of the land reform earlier. This paper--a product of the Poverty Team, Development Research Group--is part of a larger effort in the group to investigate the impact of property rights.

A theoretical framework to guide empirical analysis of how land registration affects financial development and economic growth.The author develops a theoretical framework to guide empirical analysis of how land registration affects financial development and economic growth.Most conceptual approaches investigate the effects of land registration on only one sector, nut land registration is commonly observed to affect not only other sectors but the economy as a whole.The author builds on the well-tested link between secure land ownership and farm productivity, adding to the framework theory about positive information and transaction costs. To map the relationship between land registration and financial development and economic growth, the framework links:-Land tenure security and investment incentives.-Land title, collateral, and credit.-Land markets, transactions, and efficiency.-Labor mobility and efficiency.-Land liquidity, deposit mobilization, and investment.Empirical results from applying the framework to a single case study - of Thailand, described in a separate paper - suggest that the framework is sound.This paper - a product of the Rural Development and Natural Resources Sector Unit, East Asia and Pacific Region - is part of a larger effort in the region to increase the effectiveness of country assistance strategies in the area of property rights and economic development.
