This book provides a significant contribution to the literature on land reform in various African contexts. While the economic evidence is clear that secure property rights are a necessary condition for catalysing broad-based economic development, the governance process by which those rights are secured is less clear. This book details the historical complexity of land rights and the importance of understanding this history in the process of trying to improve tenure security. Through a combination of single country case studies, comparative case studies and regional comparisons, the book is unequivocal that good governance is paramount for improving the performance of land reform programmes. Essay from the year 2016 in the subject African Studies - Culture and Applied Geography, grade: 80%, , language: English, abstract: The historical dispossession of ‘native’ land dates back to the colonial era and was reinforced and exacerbated by the apartheid Natives Land Act of 1913. The enactment of this Act saw the unequitable redistribution of land with black people only being afforded 7% of arable land. More significantly, the Act facilitated the creation of enclaves for the Black majority with the restriction on land ownership and socio-economic mobility (South African History Online, 2013). Hence, the democratic government from the year 1994 was faced with the monumental task of redressing this imbalance in land ownership and ensuring that the previously disadvantaged do not continue to be discriminated against with regards of land tenure in the country. However, land tenure reform for communal land has been marred with disputes pertaining to African tenure systems versus those influenced by colonial structures. In this regard, this paper seeks to highlight the need to decolonise communal land tenure reform for the improved implementation of rural development plans.

This book examines current trends in customary land issues in Africa, focusing on the practice of converting customary land into leasehold tenure, particularly in Zambia. Since the enactment of the 1995 Lands Act No. 29 in Zambia, conversion of customary land has become a controversial policy, raising questions about the future of customary land and rural communities, and the role of traditional authorities in a changing environment. Alienating customary land into leasehold tenure has serious implications for local and national politics and gender dynamics. Analysis of these trends suggests that the policy of creating land markets on customary land is subjecting customary systems to the forces of change. However, governments that have adopted this policy have not, by and large, adopted measures to respond to these challenges. Although customary tenure is widely believed to be resilient, it is not clear how the customary system will navigate the current winds of change. Chapters in this book draw from the Land Use and Rural Livelihoods in Africa Project (LURLAP), a collaborative research project undertaken by staff and students at the University of Cape Town and the University of Zambia.

Agricultural Land Redistribution and Land Administration in Sub-Saharan Africa: Case Studies of Recent Reforms focuses on “how” to undertake land reforms in Sub-Saharan Africa, but with relevant lessons for other developing countries. It provides details, with case studies, on how reforms were undertaken to address a pressing and controversial development challenge in Africa – land ownership inequality – and an intransigent development issue – inefficiency and corruption in land administration. An equally important contribution of the book is assessing reforms and highlighting valuable lessons for other countries contemplating reforms. The six case studies collectively cover two main areas of land governance: reforms in redistributing agricultural land and reforms in land administration. The first two case studies discuss reforms in redistributing agricultural land in Malawi and South Africa, part of the southern Africa region where land ownership inequalities rival those in Latin America. The remaining case studies, four in number, are focused on addressing corruption and inefficiency in land administration in a variety of contexts of governance including stable and post-conflict countries. The case studies cover: • Decentralizing land administration with demonstrations from Uganda, Ethiopia, Tanzania, and Ghana; • Developing post-conflict land administration systems with examples from Liberia and Rwanda; • Re-engineering and computerizing land information systems with examples from Ghana and Uganda; and • Improving management of government land through land inventories with examples drawn from Ghana and Uganda. The common elements between sometimes disparate experiences provide lessons of relevance to African and other developing countries contemplating similar reforms. The variety of land questions facing Africa and the divergent strategies proposed to resolve them continue to evoke debates. Increasingly, in response to the enduring problems of land tenure, there are land movements of all shapes and orientations, some reformist and others quite revolutionary in their agenda. However revolutionary, land movements have tended to ignore the land tenure interests of women, pastoralists, youth and indigenous people. Several of these longstanding and emerging issues in land tenure include the role of the state in land tenure reforms; urban land questions, the nature of land struggles and improvements; and, the impact of land tenure developments on particular social groups and countries. An overarching concern is the extent to which land rights are being commodified, through the conversion of land held under customary tenure systems into marketised systems. The consequences of this include growing land concentration, land tenure insecurities, diminishing access to land by various sections of society, including the poor, women and less dominant ethno-religious groups. This volume brings together different studies on Africa's land questions exploring emerging land issues on the continent in terms of the wider questions of development, citizenship, and democratisation. The chapters discuss the land question through a variety of themes. Some focus on the agrarian aspects of the land questions, while others elucidate the urban dimensions of the land question.
