La obra Las cláusulas de moralidad en los contratos de patrocinio deportivo presenta un estudio exhaustivo de esta cláusula y de su aplicación al ordenamiento jurídico español. Se trata de una disposición ampliamente utilizada en los contratos deportivos. La relevancia de esta cláusula aumenta por el auge del patrocinio deportivo, de los riesgos de escándalos que conlleva la utilización de deportistas famosos como imágenes de las empresas patrocinadoras y de los fenómenos como la corrupción y el dopaje. Sin embargo, pese a su creciente importancia y uso habitual, se trata de una disposición que ha recibido escasa o nula atención por parte de la doctrina o jurisprudencia españolas. La cláusula de moralidad cobra sentido principalmente por la tipología causal del contrato de patrocinio, en la medida que se produce una asociación de la imagen del patrocinador con la del deportista patrocinado. Su utilización plantea una problemática relacionada con la Drittwirkung, o eficacia de los derechos fundamentales en las relaciones entre particulares. En esta obra se exponen y analizan numerosos ejemplos de estas cláusulas obtenidas expresamente para esta investigación. De lo anterior deriva la oportunidad y el interés de esta obra, que, teniendo su origen en la tesis doctoral del autor, supone una aportación original y relevante en favor del uso de disposiciones individualizadas, de una redacción específica, clara y precisa, y de negociaciones que permitan a las partes disponer de alternativas ante los posibles riesgos que puedan surgir en la relación contractual. El autor, Miguel Crespo Celda, es doctor en Derecho y doctor en Psicología por la Universidad de Valencia, responsable de participación y formación del Departamento de Integridad y Desarrollo de la Federación Internacional de Tenis y tesorero del International Council for Coaching Excellence.
