Este trabajo pretende mostrar un marco regulatorio amplio para las decisiones automatizadas. Para ello, hemos partido del Reglamento General de Protección de Datos, cuyo art. 22 aporta una base sólida. Hemos mostrado las diferentes posturas doctrinales sobre el mismo, y nos hemos decantado por una interpretación sistemática del precepto, que debe ser puesto en relación con los artículos 13 a 15 del mismo texto, así como con el Considerando 71. A pesar de no mencionarse literalmente en el artículo 22 ningún derecho a la explicación de los algoritmos, emergen claramente de este marco sistemático una serie de garantías o facultades que, creemos son de utilidad. La responsabilidad algorítmica se refuerza, además, por la previsión de evaluaciones de impacto y de certificaciones. Ello dota a la regulación actual de las decisiones algorítmicas de nuevas posibilidades que deberían alejarla de la inoperancia que caracterizó a su antecedente, el art. 15 de la Directiva 95/46 CE. Con todo, estamos convencidos de que la regulación de protección del consumidor, las leyes antimonopolio y la regulación de la tecnología financiera pueden contribuir también a reforzar la responsabilidad algorítmica. La legislación antidiscriminatoria también ofrece otras posibilidades que deberían sumarse a los esfuerzos antes descritos. Por lo demás, si hay un campo en el cual las tecnologías garantes de derechos podrían ser decisivas, es éste. Creemos necesario, además, que toda esta regulación y tecnología disponga de marcos dinámicos específicos. La gobernanza resultante debería estar moderada por órganos públicos especializados y, de hecho, hemos indicado posibles candidatos ya operativos. El riesgo, siempre presente en Derecho, de no disponer de una regulación efectiva, es aquí más grave, si cabe. Aunque pueda parecer paradójico, las decisiones automatizadas supondrán un aumento de la regulación, en sentido amplio: tecno-regulación, códigos de buenas prácticas, certificaciones, estándares, evaluaciones de impacto y plataformas correguladoras. Así pues, no cabe prever una ausencia de regulación de las decisiones automatizadas, pues ésta se abrirá camino de una manera u otra. Lo que está en juego, en cambio, es el Derecho de los juristas, con sus principios y reglas. Para defender la vigencia del Derecho, que emana de los representantes del pueblo, éste debe estar presente, de manera dinámica, en la gobernanza de las decisiones automatizadas. Pretendemos, con este trabajo, contribuir al debate sobre cómo puede el Derecho liderar la gobernanza algorítmica.

La presente obra tiene como objetivo principal estudiar la incidencia de la toma de decisiones automatizadas, y en especial de la inteligencia artificial (IA) en el derecho fundamental a la protección de datos personales. Para lograr esta meta, en el primer capítulo de este trabajo tomamos como referencia las dos grandes fases que están presentes durante el ciclo de vida de los sistemas de toma de decisiones automatizadas e inteligencia artificial, estas son: i) la fase de diseño, cuyo objetivo principal es desarrollar y elaborar el sistema de toma de decisiones y, ii) la fase de despliegue, la cual tiene como finalidad la puesta en marcha del sistema en el entorno donde éste desplegará sus efectos. Realizada esta aproximación técnica inicial, en los capítulos siguientes se analiza de forma pormenorizada cómo la toma de decisiones automatizadas y el desarrollo de la IA se proyecta en la legislación europea y nacional sobre de protección de datos personales. Los distintos elementos jurídicos que presenta esta normativa se analizan e interpretan tomando como referencia la realidad presente en este tipo de sistemas automatizados.En todo momento se proponen soluciones que respeten el difícil equilibrio entre la protección adecuada de los derechos de las personas y el desarrollo apropiado de estas nuevas tecnologías.Adrián Palma Ortigosa es Doctor en Derecho por la Universidad de Valencia y Premio mejor expediente de su promoción concedido por la Real Academia de Jurisprudencia y Legislación de Granada. Su investigación se ha centrado hasta la fecha en el estudio de los derechos y garantías frente al desarrollo de las nuevas tecnologías, concretamente, las relacionadas con la inteligencia artificial y las decisiones automatizadas. Ha impartido docencia en los Grados de Derecho y Ciencia de Datos de la Universidad de Valencia. Además, forma parte de varios cursos especializados sobre derecho administrativo, protección de datos e inteligencia artificial en diversas universidades españolas. Ha colaborado con diversas instituciones privadas a través de diversos contratos de transferencia de conocimiento relacionados con las implicaciones legales del uso de sistemas de inteligencia artificial.

Recent years have seen unprecedented public scrutiny over the tax practices of Multinational Enterprise (MNE) groups. Tax policy and administration concerning international transactions, aggressive tax planning, and tax avoidance have become an issue of extensive national and international debate in developed and developing countries alike. Within this context, transfer pricing, historically a subject of limited specialist interest, has attained name recognition amongst a broader global audience that is concerned with equitable fiscal policy and sustainable development. Abusive transfer pricing practices are considered to pose major risk to the direct tax base of many countries and developing countries are particularly vulnerable because corporate tax tends to account for a larger share of their revenue. This handbook is part of the wider WBG engagement in supporting countries with Domestic Resource Mobilization (DRM) by protecting their tax base and aims to cover all relevant aspects that have to be considered when introducing or strengthening transfer pricing regimes. The handbook provides guidance on analytical steps that can be taken to understand a country’s potential exposure to inappropriate transfer pricing (transfer mispricing) and outlines the main areas that require attention in the design and implementation of transfer pricing regimes. A discussion of relevant aspects of the legislative process, including the formulation of a transfer pricing policy, and the role and content of administrative guidance, is combined with the presentation of country examples on the practical application and implementation of the arm’s length principle and on running an effective transfer pricing audit program. Recognizing the importance of transfer pricing regulation and administration for the business environment and investor confidence, this handbook aims to balance the general objective of protecting a country’s tax base and raising additional revenue with investment climate considerations wherever appropriate.
