La necesidad de que las normas se cumplan ha sido desde el principio un aspecto consustancial al mundo del Derecho. Ahora ese cumplimiento normativo ha desarrollado una perspectiva propia, en tanto en cuanto los poderes públicos pretenden aplicar nuevas políticas que tienen como objetivo cambiar comportamientos diarios de los seres humanos. Por otra parte, el desarrollo de la política en las democracias avanzadas requiere cada vez más transparencia en la definición de sus objetivos, así como en su evaluación, entendida en el sentido de qué objetivos se han cumplido y cómo se ha logrado ese cumplimiento. Asimismo, la escasez de recursos públicos después de las diferentes crisis económicas, y la necesidad de optar a qué demanda social se aplican los recursos existentes, fomentan la evaluación de las políticas públicas de cara al ciudadano. Finalmente, el reconocimiento, incluso a nivel constitucional, del derecho a la buena regulación completa el contexto actual. El análisis conductual busca los fundamentos del comportamiento humano, que a veces nos puede parecer irracional. Y es evidente que, salvo en los casos en los que se considere que los ciudadanos no cumplen de forma voluntaria las normas, la existencia de incumplimientos debe llevar a analizar su porqué, ofreciendo el análisis conductual las herramientas para llevarlo a cabo. Por último, no se puede dejar a cada gobierno en solitario la evaluación de sus políticas, sino que debe existir una estructura institucional que ejerza de forma sistemática la evaluación, aportando al debate político y a los ciudadanos hechos comprobados. Las instituciones de control externo tienen el mandato para ejercer esta función.
