"El contrato de hoy, como lo examinaremos con relativo detalle, ya no es el contrato clásico y tradicional de antaño, época en la que se enseñoreaba el liberalismo y el individualismo a ultranza, en la que el egoísmo, en estado de máxima pureza, no encontraba franco reproche y consecuente contención, en la que el ejercicio absoluto de los derechos, entre otros ‘absolutos’, ‘dogmas’, y exageraciones, no tuvieron los diques que hoy razonablemente se han edificado, en vívida demostración de que el Derecho, en general, y el de contratos, en particular, conocen límites, porque la absolutez ya no es de recibo, porque los derechos son relativos, y no pueden tornarse abusivos, o lesivos para los demás, y por cuanto la buena fe redimensionada, la solidaridad, el deber de cooperación, el respeto por el otro, por los otros, por la confianza legítima suscitada, y un largo etcétera, son las pautas que hoy informan la autonomía privada y los contratos como instrumentos suyos, permeados por una serie de valores superiores, de ordinario de raigambre constitucional –y en veces legal– (axiología negocial). De ahí que, sin abdicar del interés individual que detona la contratación, reconociéndolo y protegiéndolo con celo –en lo correspondiente–, aquella ya no pueda inscribirse en una dimensión sólo privada, sino igual y complementariamente social, porque el contrato, como una de sus manifestaciones, así sea obra colegiada, trasciende a sus artífices, y va más allá, interesando a la comunidad, al orden social, al orden público (de protección y de dirección), en una expresión, al Estado social de Derecho que no puede, no debe ser indiferente a lo que acontece con los contratantes, merecedores de acompañamiento y salvaguarda, en lo que resulte conveniente, y aplicable, claro está".

An interim outline edition of the European Commission's Common Frame of Reference (CFR) has recently been published. Over one hundred outstanding European scholars have been engaged with this CFR project. It is difficult to predict the political use to which the CFR will be put. Nevertheless, it will certainly become the cornerstone of the new European private law. For the first time, the European legal community, and indeed the global legal community, has a body of authentically European provisions suitable for adoption as national law or capable of inspiring amendments of national law. This does not mean that the CFR casts aside other mechanisms of approximation of the European national laws, in particular spontaneous harmonization. A polyedric approach is still necessary to complete the Europeanization of private law. This book brings together the papers presented at the 2007 conference on European private law organized by the University of Lleida on the occasion of the conferral of a doctorate honoris causa upon Reinhard Zimmermann. Numerous contributions attest to Reinhard Zimmermann as motivator of the scientific quest that has inspired the development of the new ius commune europaeum. Other papers deal with various substantive aspects of the Draft of the Common Frame of Reference prepared by the Study Group and the Acquis Group on behalf of the European Commission.
