The precautionary principle is widely seen as fundamental to successful policies for sustainability. It has been cited in international courts and trade disputes between the USA and the EU, and invoked in a growing range of political debates. Understanding what it can and cannot achieve is therefore crucial. This volume looks back over the last century to examine the role the principle played or could have played, in a range of major and avoidable public disasters. From detailed investigation of how each disaster unfolded, what the impacts were and what measures were adopted, the authors draw lessons and establish criteria that could help to minimise the health and environmental risks of future technological, economic and policy innovations. This is an informative resource for all those from lawyers and policy-makers, to researchers and students needing to understand or apply the principle.

The Role Of Law And Regulation In Sustaining Financial Markets

The Role Of Law And Regulation In Sustaining Financial Markets written by Niels Philipsen and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2014-11-13 with Business & Economics categories.

This book explores the role of law and regulation in sustaining financial markets in both developed and developing countries, particularly the European Union, United States and China. The central argument of this book is that law matters for the operation of financial markets, which, in turn, significantly influences the performance of firms, industries, and economies. The Role of Law and Regulation in Sustaining Financial Markets is divided into four parts. Part one addresses the connection between law, financial development, and economic growth. Part two deals with the role of financial regulation, which can be used to correct market failures, such as negative externalities, information asymmetries, and monopolies. Part three focuses on the design, functioning, and performance of different financial instruments. Part four examines the topic of Corporate Social Responsibility. This book contributes to the ‘law and finance’ literature by studying certain conventional issues, such as the relationship between finance and economic growth, and the effects of regulatory quality on financial development, from new perspectives and/or with new evidence, data, and cases. It also explores novel topics, such as project finance contracts, insurance and climate change, the shadow banking system, that have been overlooked in current literature. This book is meaningful not only for the EU and the US, which have suffered considerably from the financial crisis of 2008, but also for China, which is struggling to build a sound institutional infrastructure to govern its increasingly complicated financial system. By comparing the regulatory philosophies and practices of the EU, the US and China, this book will help the reader to understand the diverse nature of the global ‘law and finance’ nexus and avoid succumbing to the myth of "one size fits all".

Managing Facts And Feelings In Environmental Governance written by Lorenzo Squintani and has been published by Edward Elgar Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2019 with Law categories.

This timely book brings to the foreground the considerable tensions between the need to engage the public in the importance of environmental governance and the need of professional expertise to address the issues which arise. In doing so, it highlights that not only can public opinion deviate from scientific knowledge, but scientific knowledge itself can be lacunose or contradicting. Drawing together insights from some of the leading scholars, this engaging work will provide guidance to decision makers, including judges, on how to govern public participation procedures and professional expertise and the role that the precautionary principle can play in this regard.

The precautionary principle provides a justification to act where scientific uncertainty about the nature and extent of detected indications of harm would otherwise possibly impede regulatory interventions. The highly controversial and often misunderstood principle plays a central role in European risk regulation. The present volume should allow readers to gain an overview of all essential points linked with the role of the principle in the risk regulation framework of the European Union. Based on an outline of the precautionary principle’s main characteristics and its conception by the European Commission, common allegations brought against the principle are illuminated and critically assessed. The second part of the book is then devoted to the actual implementation of the principle in the EU – from early applications to ongoing disputes. Three case studies from the agrochemical, pharmaceutical and food packaging sector reflect current applications as well as the relevant institutional and procedural framework. Insights from the theoretical part and the case studies are melted in the final discussion section that also includes recommendations for EU risk regulators.

Chapter 2, 'Pay no attention to the model behind the curtain', Chapter 4, 'Mind the hubris: Complexity can misfire', and Chapter 8, ' Sensitivity auditing: A practical checklist for auditing decision-relevant models' are published open access and free to read or download from Oxford Academic The widespread use of mathematical models for policy-making and its social and political impact are at the core of this book. While the discussion of mathematical modelling generally centres around technical features, use, and type of model, the literature is increasingly acknowledging that the social nature of modelling, its biases and responsibilities, are equally worth investigating. This book tackles these emerging questions by adopting a multidisciplinary approach to investigate how current modelling practices address contemporary challenges, and fills a gap in the field, which has historically focused on statistical and algorithmic modes of producing numbers. Thanks to its multidisciplinary appeal, this book will be essential reading for modellers, public officials, policymakers, and scholars alike.

The discourse of education for sustainability has been severely limited by the fact that it largely refuses to acknowledge important insights from other fields of learning and knowledge. This reluctance to engage with central insights regarding how the world and, more specifically, how human interactions with both the human and non-human world work, ensures that it has remained a largely self-centred discourse. It is tangled up with reflections on education without contextualising them in the...

Back Cover Copy Humans have exploited a huge diversity of materials throughout history. Today’s conflict between rising demands and dwindling resources raises searching questions about how optimally to meet humanity’s needs efficiently and safely, challenging common assumptions. Plastics support many facets of modern life yet raise associated problems, whilst ‘natural’ materials may be far from benign when inputs extending their longevity are considered. PVC (polyvinyl chloride) is a plastic with adaptable, durable and other properties used in diverse construction, medical, information technology, domestic and many applications besides. However, PVC has faced significant NGO pressure relating to its chlorine content and the range of additives conferring desirable properties. Yet, unlike organochlorine pesticides, PVC plastic is inert and recyclable after providing long service life. This book is not ‘pro-PVC’, but draws on lessons learned from how the PVC value chain, particularly across Europe, has engaged with problems and made further progress under voluntary commitments to sustainable development. The book advocates a ‘level playing field’ of common sustainability principles for assessment of the benefits and risks of the use of all materials in the context of their incorporation within whole product life cycles, from raw material extraction to beyond end-of-life. The use of every material raises specific challenges, but also shares common problems arising from society’s legacy of wasteful, linear resource use. Activities surrounding the PVC value chain have generated novel ideas, assessment techniques and reconsideration of regulatory approaches relevant to sustainability assessment of the use of all materials in the context of whole product life cycles on a common ‘level playing field’, which best supports the meeting of the diversity of human needs in the safest and most efficient manner. This book is aimed at industry, regulatory and NGO audiences and influence on wider media.
