Legislatures, the judiciary and civil society are important actors in representative democracies. In what ways and how well do they represent? And how effectively do they carry out their institutional and social roles? Both questions refer to the key dimensions of democracy analyzed in this book: representativeness and effectiveness, respectively. While they have been developed separately in scholarly work on institutions and regimes, there is little work considering them simultaneously, and on their interaction. Using quantitative and/or qualitative methods, contributions from top scholars in the field of legislatures, the judiciary and civil society examine these two concepts and their relationships in four Latin American countries: Argentina, Brazil, Chile, and Mexico. Designed to guide the reader through the complexities of this debate, each expert engages in a larger set of theoretical debates about different approaches to representation in each sphere. In this volume, twelve experts on Latin American politics investigate the ways in which the interaction between legislative institutions and the policy positions of key actors affects the initiation and passage of legislation, covering seven Latin American Countries: Argentina, Brazil, Chile, Colombia, Mexico, Peru, and Uruguay. These seven presidential systems vary widely in terms of their legislative institutions and the position of relevant actors. The introduction provides a framework to understand the interaction of legislative majorities, political institutions, and policy position, and each chapter begins with a description of the constitutional and congressional rules that allocate powers to propose, amend, and veto legislation. The authors then identify the political actors who have these prerogatives and apply the framework to show how their policy positions and relative strengths influence legislative decision-making. The findings are consistent with the basic argument of the book that presidents with extensive legislative powers may be constrained by the positions of their legislative allies, whereas weaker presidents may be well-positioned to build successful coalitions to achieve their legislative goals. The essays in this volume demonstrate that institutional design, which determines the allocation of legislative powers, must be considered along with the policy preferences of key legislative actors in order to construct a full picture of law-making. Weston Agor’s carefully documented analysis of the organization and workings of the Chilean Senate is the first of its kind and fills a long-standing need in the comparative study of the internal structure of legislative bodies. Making eclectic use of role, power, and exchange theories, Agor bases his discussion on personal interviews with senators and staff as well as on extensive observation of the Senate in action during 1967–1968. He also analyzes in detail relevant documents, committee reports, and floor debates. Focused primarily on the formal decision-making structure within the Senate and on internal norms, both formal and informal, that hold that structure together, Agor’s study fruitfully compares the Chilean Senate with its peers, including the United States Senate, to which it bears surprising resemblance in form and function. Agor examines the role of compromise and informal rules of the game in achieving a majority vote in the Senate, the power of committees and committee presidents, and political party control over Senate members. The influence of the executive, particularly in the passage of executive legislation, and its effect on the Senate’s internal system of checks and balances—both stated and understood—are examined in terms of their effect on the political strength of the Senate. The Chilean Senate, unlike its counterparts in most other “developing countries,” has exercised genuine and effective influence in the national political system. In an epilogue to this study, Agor views events since 1968, including the election of Allende, that affected the future role of the Senate in Chilean politics.
