According to Robert Rodes, liberation theology -- with its concern for the individual's to respond to building God's kingdom; its demand that Christians align themselves with the oppressed and work to reform or dismantle unjust social structures; and its recognition of the Church as a sign of God's salvific and liberating purpose -- gives to the pursuit of justice through law an eschatological significance independent of any immediate or predictable consequences. Rodes assigned new importance to laws that symbolize aspirations they cannot fully implement, and laws that confront destructive forces they cannot fully implement, and laws that confront destructive forces they cannot fully contain. He begins by briefly discussing the basic tenets of liberation theology and relates them to goals that traditional jurisprudence has assigned to law. In later chapters he develops agendas for ameliorating some of the major problems in contemporary American life, rootlessness, powerlessness. He addresses each in light of past perceptions, how a Christian should respond to them today, and how law can respond to them.

What is the American rule of law? Is it a paradigm case of the strong constitutionalism concept of the rule of law or has it fallen short of its rule of law ambitions? This open access book traces the promise and paradox of the American rule of law in three interwoven ways. It focuses on explicating the ideals of the American rule of law by asking: how do we interpret its history and the goals of its constitutional framers to see the rule of law ambitions its foundational institutions express? It considers those constitutional institutions as inextricable from the problem of race in the United States and the tensions between the rule of law as a protector of property rights and the rule of law as a restrictor on arbitrary power and a guarantor of legal equality. In that context, it explores the distinctive role of Black liberation movements in developing the American rule of law. Finally, it considers the extent to which the American rule of law is compromised at its frontiers, and the extent that those compromises undermine legal protections Americans enjoy in the interior. It asks how America reflects the legal contradictions of capitalism and empire outside its borders, and the impact of those contradictions on its external goals. The natural law reconsidered here is the Thomistic theory previously defended by the author. It is argued that Aquinas removes the legal vocabulary, convenient in view of the Biblical pedagogy, to such an analogical plane that it forms no essential part of his vision of the good life, open to creativity and individual <I>vocation. The thesis of love as the -form of all the virtues- is tested against concrete topics. Ultimate happiness is a unifying human goal and the Gospel beatitudes are, in Aquinas, here and now the charter for this. Natural and hence common human inclinations originate and order ethical imperatives, which thus stem from biogenic roots. Creativity is the sign and effect of such love, integrating ethical and aesthetic motivation. Inert moralism is thus superseded."
