This book brings together leading international scholars of law and religion to provide an overview of current issues in State-religion relations. The first part of the collection offers a picture of recent developments in key countries and regions. The second part is focused on Europe and, in particular, on the Nordic States and the post-communist countries where State-religion systems have undergone most profound change. The third and final part is devoted to four issues that are currently debated all over the world: the relations between freedom of expression and freedom of religion; proselytism and the right to change religion; the religious symbols; and the legal status of Islam in Europe and Canada. The work will be a valuable resource for academics, students and policy-makers with an interest in the interaction between law and religion.

Caspar David Friedrich's painting on the cover of this book is a metaphor: Scholarly relations between law & religion seemed to be destroyed through modernity. The book however argues for new life in the ruins. --

In spite of the debate about secularization or de-secularization, the existential-bodily need for religion is basically the same as always. What have been changed are the horizons within which religions are interpreted and the relationships within which religions are integrated. This book explores how religions continue to challenge secular democracy and science, and how religions are themselves being challenged by secular values and practices. All traditions - whether religious or secular - experience a struggle over authority, and this struggle seems to intensify with globalization, as it has brought people around the world in closer contact with each other. In this book internationally leading scholars from sociology, law, political science, religious studies, theology and the religion and science debate, take stock of the current interdisciplinary research on religion and open new perspectives at the cutting edge of the debate on religion in the 21st century.

Law Religion And Tradition written by Jessica Giles and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2018-09-27 with Law categories.

This book explores different theories of law, religion, and tradition, from both a secular and a religious perspective. It reflects on how tradition and change can affect religious and secular legal reasoning, identifying the patterns of legal evolution within religious and secular traditions. It is often taken for granted that, even in law, change corresponds and correlates to progress – that things ought to be changed and they will necessarily get better. There is no doubt that legal changes over the centuries have made it possible to enhance the protection of individual rights and to somewhat contain the possibility of tyranny and despotism. But progress is not everything in law: stability and certainty lie at the core of the rule of law. Similarly, religions and religious laws could not survive without traditions; and yet, they still evolve, and their evolution is often intermingled with secular law. The book asks (and in some ways answers) the questions: What is the role of tradition within religions and religious laws? What is the impact of religious traditions on secular laws, and vice-versa? How are the elements of tradition to be identified? Are they the same within the secular and the religious realm? Do secular law and religious law follow comparable patterns of change? Do their levels of resilience differ significantly? How does the history of religion and law affect changes within religious traditions and legal systems? The overall focus of the book addresses the extent to which tradition plays a role in shaping and re-shaping secular and religious laws, as well as their mutual boundaries.

Constitutionalism And Religion written by Francois Venter and has been published by Edward Elgar Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2015-10-30 with Law categories.

This topical book examines how the goals of constitutionalism – good and fair government – are addressed at a time when the multi-religious composition of countries’ populations has never before been so pronounced. How should governments, courts and officials deal with this diversity? The widely accepted principle of treating others as you wish them to treat you and the universal recognition of human dignity speak against preferential treatment of any religion. Faced with severe challenges, this leads many authorities to seek refuge in secular neutrality. Set against the backdrop of globalized constitutionalism in a post-secular era, Francois Venter proposes engaged objectivity as an alternative to unachievable neutrality. Bringing together the history of church and state, the emergence of contemporary constitutionalism, constitutional comparison and the realities of globalization, this book offers a fresh perspective on the direction in which solutions to difficulties brought about by religious pluralism might be sought. Its wide-ranging comparative analyses and perspectives based on materials published in various languages provide a clear exposition of the range of religious issues with which the contemporary state is increasingly being confronted. Providing a compact but thorough historical and theoretical exposition, this book is an invaluable resource for students, constitutional scholars, judges and legal practitioners.

Law. Religion. Do they have anything to say to each other? If so, what, and toward what end? And is the notion of productive dialogue between these two fields not surprising but essential? Long considered unlikely bedfellows at best and, at worst, outright opponents, law and religion have been meeting in significant ways, thanks to the seminal and ongoing work of Emory University??'s Center for the Study of Law and Religion (CSLR), where scholars worldwide come together for this express purpose. Neither belligerently butting heads nor cozying up for a t?te-?-t?te, representatives of these two disciplines are daring to look at the big questions that bridge their domains ? and are daring to propose ways of working together. These encounters go way beyond verbal sparring and schmoozing. Joining the ranks of law and religion professors at CSLR conferences are the leaders of major religions in the U.S. ? Judaism, Islam, and multifaceted Christianity ? along with psychologists, sociologists, biologists, and policy makers. Commemorating CSLR??'s twenty-fifth anniversary, When Law and Religion Meet traces what motivated the Center??'s beginnings, what has impelled its work over the last quarter century, and what fuels the trajectory of law and religion, both separately and together, as they continue in productive dialogue. This pithy, illustrated volume is one that a wide range of readers will want to skim, explore, and return to.
