Le droit africain des droits de la femme s’inscrit dans le continuum du droit international des droits de la femme, afin de régler les particularités des droits de la femme en Afrique. Autrement dit, c’est un droit complémentaire au système universel de protection des droits de la femme et spécifique aux droits de la femme en Afrique. Substantiellement constitué par des normes conventionnelles et coutumières, le droit africain des droits de la femme est en construction aux niveaux régional, sous-régional et national. Au niveau du continent africain, il s’articule essentiellement autour du Protocole de Maputo, qui complète la Charte africaine des droits de l’homme et des peuples sous cet angle, en s’attachant tout spécialement à l’interdiction et à l’élimination de la discrimination à l’égard des femmes. Outre l’Union africaine, la Cour et la Commission africaines des droits de l’homme et des peuples, différentes structures ont été mises en place pour assurer l’interprétation et l’application des droits de la femme. Si des avancées peuvent être constatées, l’effectivité de ces droits demeure problématique en Afrique, où les luttes et revendications sont permanentes, ce que démontrent les contributions réunies dans le présent ouvrage à travers une perspective d’ensemble, une approche des systèmes sous-régionaux et des éclairages plus spécifiques.

This second revised edition takes into account the decision of the International Court of Justice in the "Nottebohm Case" which was published just as the first edition was going to press and therefore received only cursory treatment. It also, of course, includes an analysis of international legislation adopted since 1955, including the 1961 UN Convention on the Reduction of Statelessness, the 1957 UN Convention on the Nationality of Married Women, and the 1966 International Covenant on Civil and Political Rights. The decisions of international tribunals and, in particular, of the Italian Conciliation Commissions are analysed. Finally, the author presents legislative, judicial and governmental practice during the twenty-two years. After beginning with a clear definition of terms, the author analyses the functions of nationality in international law, the relationship between municipal and international law and then the public international law of nationality. In this latter part, he examines international conventions, international custom and the principles of law generally recognized with regard to nationality. The book ends with a summary and conclusions dealing with the existing law and future developments.
