Il rassemble les contributions qui ont été rédigées à l’occasion de la Journée de Droit de la Propriété Intellectuelle (www.jdpi.ch) organisée le 5 février 2015 à l’Université de Genève sur le thème « Le droit du design / Design Law ». Il ne fait pas de doute que l’apparence extérieure des produits qui nous entourent est susceptible d’exercer une force d’attraction importante, voire une fascination sur le public des consommateurs. Preuve en est la valeur phénoménale progressivement acquise par une firme californienne à la désormais célébrissime pomme – qui était, il faut le rappeler, au bord du gouffre il y a quelques années –. Cette firme a en effet su inventer ou réinventer des produits technologiques à destination de tous à la ligne épurée et attractive, qu’il s’agisse de téléphones, de tablettes ou d’autres produits électroniques. Il est certes clair que l’attractivité de ces produits ne tient pas exclusivement à leur apparence, mais également à leur convivialité et fonctionnalités technologiques. On ne peut toutefois pas doutes que leur « look » y contribue aussi (largement). Il n’est dès lors pas surprenant que nombre d’entreprises dans des secteurs et industries très variés consacrent d’importantes ressources et leur énergie créatrice à développer des produits au design unique, destiné à les distinguer de ceux de leurs concurrents. Comment le droit du design peut-il dès lors protéger cette créativité des produits et à quelles conditions ? Juger du pouvoir d’attraction de la forme d’un produit n’est pas tâche aisée. C’est en somme tenter de faire écho sur le plan légal à la phrase du célèbre designer Milton Glaser : « There are three responses to a piece of design : yes, no and … WOW. WOW is the one to aim for ». Pour explorer le domaine évolutif du droit du design, les auteurs des remarquables contributions qui composent ce livre se sont penchés sur diverses facettes de la thématique en droit international et national. Qu’ils soient chaleureusement remerciés pour leur précieux travail et que M. Pierre Heuzé qui s’est chargé des tâches d’édition du livre trouve ici aussi l’expression de ma vive reconnaissance.

Intellectual property rights, conventionally seen as quite distinct, are increasingly overlapping with one another. There are several reasons for this: the expansion of IPRs beyond their traditional borders, the creation of new IPRs especially at EU level, the exploitation of gaps in the law by shrewd lawyers, and the use of unfair competition as an alternative when IPRs are either not available at all or expired. The convergence of several IPRs on the same subject-matter poses problems. As they are normally envisaged as water-tight categories, there are very few rules which cater for the sort of regime clash that any overlap of IPRs necessarily entails. This book's aim is to find appropriate rules to regulate overlaps and thereby avoid regime conflicts and undue unstructured expansion of IPRs. The book studies the practical consequences of each overlap at the international, European and national levels (where the laws of France, the UK and Germany are reviewed). It then analyses the reasons for the prohibition or authorisation of overlaps. This analysis enables the determination of criteria and principles that can be used to (re)map the overlaps to achieve appropriateness and legitimacy.

Protection of industrial and other designs has developed as a distinct and important area of intellectual property law. This book was developed within the framework of the International Association for the Protection of Intellectual Property (AIPPI), a non-affiliated, non-profit organization dedicated to improving and promoting the protection of intellectual property at both national and international levels. The authors of the country chapters have been carefully selected based on their extensive experience and in-depth knowledge about design protection in their respective jurisdictions. Each chapter considers such issues and topics as the following: • availability of protection – granting authority, statutory requirements, drawing requirements, and disclaimers; • tests or approaches applied to determine whether a design right is ineligiblefor protection based on functionality grounds, including related policy considerations; • strategies employed to mount, and fend off, challenges to design rights based on functionality; • determination of a design right’s scope of protection, including the impact of any visual elements of the overall design having appearances that are non-novel and/or functional; • tests or approaches applied to determine whether a visual element of a design right is excluded from the overall scope of protection based on functionality grounds, including related policy considerations; • examples of how visual elements of a design right whose appearance is driven by function are treated in infringement and validity contexts.
