La common law est née sur une île après allie aventure maritime brève certes, mais néanmoins périlleuse qui se place en 1066. Depuis ce moment, à travers toute l'histoire du pays, ce caractère insulaire a été essentiel. Pendant les siècles, qui s'étendent de la création de l'Etat de la Manche par Henry Il, jusqu'à la fin de la Guerre de Cent Ans, les souverains anglais n'ont cessé d'utiliser, pour le meilleur ou pour le pire, le corridor maritime les séparant du Continent. Puis est venu le temps des corsaires ainsi que la création de la Royal Navy sous les Tudors et enfin ce glorieux XIX° siècle qui s'ouvre à Trafalgar par une victoire maritime et se termine par la maîtrise commerciale et militaire des mers du globe au chant : de Britannia Rule the Waves. Que les juristes de common law aient été associés à ce prodigieux essor à travers le développement d'un droit maritime dont l'un des symboles était et demeure le Lloyd's de Londres, n'a rien qui doive surprendre. C'est dire toute l'importance du droit maritime dans le contexte de la common law. C'est dire aussi qu'il ne faut pas s'étonner que l'âge d'or du droit maritime anglais soit précisément la seconde moitié du XIX° siècle et ses prolongements jusqu'au lendemain de la Seconde Guerre mondiale. On en retrouve une trace dans le nombre de décisions de cette époque qui continuent à faire référence plus d'un siècle plus tard. Certes les temps ont changé dans la seconde moitié du XX° siècle, mais la contribution de la common law anglaise au vaste monde du droit maritime demeure. L'approcher revient à s'introduire au droit maritime tout entier.
