Le point de depart qui a conduit, d'abord, l'Italie et, ensuite, la France a la creation d'un corpus homogene de normes penales, dans le domaine des infractions contre l'administration de la justice, a ete le fait de reconnaitre la justice, en tant que bien juridique autonome, meritant une protection penale. Le temoin occupant une place de premier ordre, dans la recherche et la manifestation de la verite en justice, les infractions qu'il peut commettre et, notamment, le faux temoignage et la subornation de temoin, sont celles qui peuvent compromettre, le plus, l'integrite de la justice. L'etude comparee qui a ete realisee, montre qu'en France et en Italie, les legislateurs ont adopte des dispositions assez proches, en matiere d'infractions relatives au temoignage. Au niveau du droit penal de fond, les deux Pays ont reussi a creer des infractions, potentiellement, capables de garantir le bien juridique de l'integrite de la justice. Toutefois, sur le plan procedural, certains doutes apparaissent, puisque les deux systemes penaux ont tendance a sanctionner les deux infractions, en les dissociant des affaires principales, au cours desquelles elles se sont realisees.
