Il presente testo rappresenta il frutto del lavoro condiviso di un gruppo di esperti specializzati in materia di personale nella pubblica amministrazione che hanno approfondito tutti gli aspetti sia sul piano strettamente giuridico sia sul piano di una corretta gestione delle risorse umane. Aggiornato a tutte le recenti novità che riguardano le Regioni e gli Enti locali, incluso il D.L. 101/2013 convertito in L. 125/2013, l’opera analizza anzitutto i presupposti di natura normativa e finanziaria per una selezione efficace del personale, dall’interno e dall’esterno. Particolare attenzione viene dedicata ai vincoli di spesa, con riferimento sia alle assunzioni a tempo indeterminato, sia alle forme di lavoro flessibile. Viene poi approfondita la tematica dei diritti e dei doveri del dipendente pubblico, con particolare riferimento alla leva motivazionale che sta assumendo in questi ultimi anni un ruolo sempre più centrale nella gestione delle risorse umane ai fini di una performance efficace ed efficiente. Una attenta analisi è dedicata, da un lato, ai diritti della persona sul lavoro e alle tre “dimensioni del benessere”, dall’altro, al nuovo Codice di comportamento, strumento fondamentale per migliorare la produttività sul lavoro e i rapporti con gli utenti dei servizi. Infine, viene illustrata l’organizzazione dell’Ente locale, orientata alla valorizzazione della dirigenza e alla misurazione degli obiettivi. Un cenno particolare merita la questione strategica della gestione associata dei servizi: le Unioni di comuni costituiscono uno dei principali percorsi di riforma della pubblica amministrazione, alla ricerca di standard soddisfacenti di funzionalità e trasparenza. Di particolare interesse la selezione di pareri delle Sezioni di Controllo della Corte dei Conti, richiamati e sintetizzati per argomento. Un’opera completa, di taglio scientifico, eppure ricca di spunti concreti, destinata agli studiosi ma anche agli amministratori ed operatori delle Regioni e degli Enti locali. The driving cultural force of that form of life we call ‘modern’ is the desire to make the world controllable. Yet it is only in encountering the uncontrollable that we really experience the world – only then do we feel touched, moved and alive. A world that is fully known, in which everything has been planned and mastered, would be a dead world. Our lives are played out on the border between what we can control and that which lies outside our control. But because we late-modern human beings seek to make the world controllable, we tend to encounter the world as a series of objects that we have to conquer, master or exploit. And precisely because of this, ‘life,’ the experience of feeling alive and truly encountering the world, always seems to elude us. This in turn leads to frustration, anger and even despair, which then manifest themselves in, among other things, acts of impotent political aggression. For Rosa, to encounter the world and achieve resonance with it requires us to be open to that which extends beyond our control. The outcome of this process cannot be predicted, and this is why moments of resonance are always concomitant with moments of uncontrollability.
