Con la “Riforma Cartabia” è stata realizzata una complessa rivisitazione del sistema penale, che ha coinvolto più piani: processuale, sostanziale, organizzativo. Nell’intento dichiarato di decongestionare la macchina giudiziaria e raggiungere gli obiettivi fissati dal Piano Nazionale di Ripresa e Resilienza (PNNR), si è inciso su taluni punti nevralgici della dinamica processuale e della disciplina sostanziale: indagini preliminari, udienza preliminare, giudizio, impugnazioni, esecuzione, sistema sanzionatorio. Al contempo, si è introdotta un’inedita regolamentazione organica della giustizia riparativa, quale modello complementare non necessario rispetto alla giustizia penale. Il presente volume cerca di ricostruire le descritte innovazioni, allo scopo di coadiuvare il lettore a orientarsi nella comprensione di una riforma che più che “sistematica” appare “corposa” e articolata, coinvolgendo l’intera sequenza procedimentale e – correlativamente – il piano sanzionatorio. Il testo è aggiornato al decreto legislativo 19 marzo 2024, n. 31, recante “Disposizioni integrative e correttive del d.lgs. n. 150/2022”, alla legge 24 novembre 2023, n. 168, recante “Disposizioni per il contrasto della violenza sulle donne e della violenza domestica”, e al d.d.l. n. 893, d’iniziativa dei deputati Pittalis e altri, che incide su un profilo centrale della riforma: l’istituto dell’improcedibilità, che viene abrogato, reintroducendosi nei giudizi di appello e legittimità la prescrizione del reato.
