Il est facile mais réducteur de voir, dans la séparation de deux phases au sein du courant critique américain (différent du courant européen), un affrontement politique tournant autour de la notion de droits. En fait, le mouvement des Critical Legal Studies est le lieu où se manifeste le mieux le passage de la pensée juridique moderne en crise à la postmodernité en théorie du droit. Duncan Kennedy, Joseph W. Singer ont su décrire parfaitement les difficultés rencontrées par la pensée juridique moderne. Avec Jack Balkin, John Leubsdorf et Martha Minow, une perspective post-moderne s'ouvre, où l'attention à l'autre se substitue à l'obsession du même, où tout se fait interprétation, où les potentialités du langage et des textes sont scrutées, sous l'influence, entre autres, des écrits de Jacques Derrida. La distinction entre les courants CLS et Droit et Littérature s'estompe alors.

Les représentants des Critical Legal Studies se sont attaqués à une conception libérale trop simpliste du processus de décision judiciaire et des doctrines juridiques bien davantage qu'ils n'ont rejeté toute forme de libéralisme. La préparation du bicentenaire avait été, pour les historiens américains, l'occasion de rappeler une tradition républicaine un peu oubliée et certains des représentants des CLS ont cherché dans un républicanisme repensé une réponse aux problèmes qu'ils rencontraient. Cet ouvrage a pour but de faire découvrir comment la théorie américaine du droit, à partir des Critical Legal Studies, a envisagé le rapport de l'individu et de la société et les solutions adaptées au pluralisme (post)moderne. Les deux articles de Frank I. Michelman, ici traduits par Françoise Michaut, sont devenus des classiques. Ils invitent à suivre la Cour suprême des Etats-Unis dans ses modes de raisonnement et à voir comment la doctrine vient ensuite, par sa réflexion, enrichir le débat sur le problème qu'a eu à traiter la Cour.
