L'élément psychologique de l'infraction, incarné par la volonté criminelle, est indispensable à toutes les infractions. Cependant, dans l'ambiance d'une confusion totale, l'ensemble des faits psychologiques de l'infraction est souvent qualifié d' "intention coupable". Or, l'intention, en droit pénal, est liée à une notion de prévisibilité. Les modèles de la théorie générale de l'acte juridique et du droit commun sont bouleversés en droit du travail, en ce qui concerne la volonté dans la formation de l'acte juridique. Les techniques et la logique propres au droit du travail remettent en effet en cause des acquis de la science du droit et du droit positif par un double mouvement d'infléchissement. En premier lieu, le rôle de la volonté dans la formation de l'acte juridique est atténué en droit du travail. En effet, le rôle d'un accord de volontés est parfois totalement ignoré par les magistrats qui qualifient l'acte ainsi formé d'unilatéral, et non de conventionnel. L'objectif est alors d'assurer la destination collective de la volonté exprimée. En outre, le rôle de la volonté individuelle émanant tant du salarié que de l'employeur peut être nié lorsqu'il s'agit pour le droit du travail d'assurer l'efficacité de ses normes. Un acte juridique pourra ainsi être caractérisé sans le support pourtant indispensable de leur volonté. En second lieu, le régime de la volonté dans la formation de l'acte juridique tel qu'il est établi en droit commun est modifié en droit du travail. Le droit spécial manifeste alors son autonomie soit par l'absorption de notions participant du régime de la volonté, soit par la systématisation de l'opposition entre l'employeur et le salarié à travers l'utilisation différenciée de certaines de ces notions.
