L’opera, aggiornata alle recenti interpretazioni giurisprudenziali, riporta l’analisi degli istituti riguardanti le servitù e gli altri diritti reali quali: superficie, enfiteusi, usufrutto, uso e abitazione. La struttura del testo è disposta con impostazione operativa che indica con commento ed intercalare di citazioni qual è la giusta interpretazione applicativa dell’istituto. Di ognuno di essi si analizza la costituzione e la relativa disciplina per poi giungere alla tutela del diritto e alla responsabilità che ne discende. Quindi si discorrerà di ambulatorietà, servitù discontinue, forma scritta, servitù negative, ma ci si porranno anche domande eminentemente pratiche quali, ad esempio, che cosa s’intenda in ambito di servitù per “utilità”; se la servitù possa esser costituita per assicurare al fondo un vantaggio futuro; come possa costituirsi, in pratica, una servitù; se l’esenzione prevista dall’art. 1051, comma 4, c.c. in favore di case, cortili, giardini ed aie ad esse attinenti trovi applicazione nel caso contemplato dall’art. 1054 c.c.; cosa succeda quando dovesse cessare la c.d. interclusione del fondo; se il proprietario del fondo dominante possa effettuare opere sul fondo servente; se il diritto di superficie possa esser considerato un minus rispetto al diritto di proprietà; che cosa succeda qualora la costituzione del diritto di superficie sia stata fatta per un tempo determinato; come possa essere esercitata una servitù; che cosa accada al diritto d’enfiteusi se il fondo dovesse perire parzialmente o totalmente; se il diritto d’enfiteusi possa essere ceduto; a cosa serva la c.d. ricognizione; se l’enfiteuta possa concludere contratti di locazione; se il contratto di compravendita del diritto di usufrutto debba esser considerato contratto aleatorio; quando l’alterazione dell’originaria destinazione economica del bene configuri abuso; se l’usufruttuario possa essere, nel contempo, anche locatore; se l’articolo 999 del codice civile si riferisca anche ai contratti di mezzadria; se il nudo proprietario possa assumere la qualità di conduttore della res oggetto d’usufrutto; se la persona giuridica possa essere titolare di diritto reale d’uso; quale sia l’oggetto possibile del diritto reale d’uso; se nel diritto reale d’abitazione a favore del coniuge superstite, la casa coniugale debba esser stata di proprietà del de cuius.
