Le droit français s'est doté de dispositions spécifiques en matière de lutte contre le terrorisme à partir de la loi n° 86-102 du 9 septembre 1986. Par la suite, le Code pénal de 1994 a intégré les infractions relatives au terrorisme aux articles 421-1 et suivants, dans le Livre IV consacré aux crimes et délits contre la nation, l'Etat et la paix publique. Depuis lors, les très nombreuses réformes qui caractérisent la matière n'ont eu de cesse de développer l'autonomie des incriminations et le recours à des procédures d'exception pour tenter de proposer une réponse adaptée à "la menace terroriste". Cette tendance s'est encore récemment renforcée après les derniers attentats commis sur le sol français, et particulièrement ceux de janvier et de novembre 2015. Plus qu'en tout autre domaine, la répression se trouve associée à une volonté de prévenir les infractions. Or, la prévention à l'état pur, celle qui consisterait à identifier et réprimer les auteurs avant le passage à l'acte, est difficilement compatible avec les principes directeurs du droit pénal et soulève un délicat problème d'équilibre de la législation tant le risque d'atteinte aux libertés individuelles est fort. La dernière réforme, issue de la loi n° 2016-731 du 3 juin 2016 renforçant la lutte contre le crime organisé, le terrorisme et leur financement et améliorant l'efficacité de la procédure pénale, illustre parfaitement ce dilemme. Cette loi, particulièrement dense, use de tous les leviers de la matière pénale. Elle prévoit de nouvelles incriminations, propose d'adapter les peines ainsi que la mise en oeuvre d'une politique pénitentiaire favorisant la "dé-radicalisation". Surtout, elle contient un important volet procédural qui confère aux enquêteurs de nouvelles prérogatives en autorisant le recours à certains procédés tels que l'IMSI catcher. Comme la récente loi sur le renseignement du 24 juillet 2015, la réforme du 3 juin 2016 suscite un véritable questionnement quant au respect des libertés et droits fondamentaux, notamment la vie privée. En filigrane, c'est également la pertinence d'une politique pénale sujette à de telles variations qui peut être discutée. La répétition des réformes, plutôt que la réactivité des pouvoirs publics, ne traduirait-elle pas finalement une certaine incapacité à saisir et à endiguer l'activité terroriste ? L'ouvrage aborde l'ensemble de ces aspects afin de discuter des principales dispositions de la loi du 3 juin 2016, dans un contexte d'état d'urgence prolongé, avec le souci de "croiser les regards" dans la perspective d'élargir la perception du terrorisme et de ses enjeux par une combinaison des approches : juridiques et criminologiques, universitaire et pratiques, répressives et préventives, de droit interne et de droit européen.

This volume offers a coherent analysis of the European Union’s security strategies within a comparative framework. If the EU is to survive and prosper as an effective security actor, it requires that greater attention be devoted to taking a cohesive and common position on the relationship between EU foreign policy means and goals. The major claim of this edited collection is that there is a European grand security strategy that disciplines member state security strategies. That grand strategy has two distinct substantive goals: (1) the preservation and expansion of the EU system of security governance; and (2) the implementation of specific strategies to meet internal and external threats and sources of insecurity. The EU has sought to develop a grand security strategy that not only accounts for the proliferation of threats possessing a military or non-military character and differentiates between core and peripheral regions of interest, but also addresses the requirements to bridge the increasingly blurred boundary between internal and external security threats and the necessary reconciliation of the competing security preferences of its member states. The empirical contributions to this volume examine the EU security strategies for specific issue areas and regional threat complexes. These case studies assess whether and how those strategies have consolidated or expanded the EU system of security governance, as well as their successes and limitations in meeting the security threats confronting the EU and its member-states. The expression 'the criminal question' does not at present have much currency in English-language criminology. The term was carried across from Italian debates about the orientation of criminology, and in particular debates about what came to be called critical criminology. One definition offered early in the debate described it as 'an area constituted by actions, institutions, policies and discourses whose boundaries shift'. According to this writer, crime, and the cultural and symbolic significance carried by law and criminal justice, is an integral aspect of the criminal question. 'The criminal question' draws attention to the specific location and constitution of a given field of forces, and the themes, issues, dilemmas and debates that compose it. At the same time it enables connections to be made between these embedded realities and the wider, conceivably global, contours of influence and flows of power with which it connects. This in turn raises many questions. How far do the responses to crime and punishment internationally flow from and owe their contemporary shape to the cultural and economic transformations now widely known as 'globalisation'? How can something that is in significant ways embedded, situated, and locally produced also travel? What is not in doubt is that it does travel - and travel with serious consequences. The international circulation of discourses and practices has become a pressing issue for scholars who try to understand their operation in their own particular cultural contexts. This collection of essays seeks a constructive comparative view of these tendencies to convergence and divergence.
