Of particular concern is an insistence on democracy and transparency radically different from strategic and instrumental conceptions – a space for dialogue and dissent, an opportunity for crea-tivity, experimentation and re-imaginings. About the publication In the second edition of PULP FICTIONS we continue the search for a vibrant and active public sphere through debate. As in the first edition, the dialogue is one between two academics from the faculty of law and, as in the first edition, different conceptions of law, politics and the role of the academic are teased out. The context of the debate in this edition is a series of research meetings of the Department of Legal History, Comparative Law and Jurisprudence at the UP Law Faculty. Over a course of a few of these meetings different perspectives on law, politics and the limits/ potential of the law were voiced by different colleagues.Tshepo Madlingozi presented in one of the meetings his views on the role of legal academics in progressive politics. In this contribution, which appears here, he urges all of us to move ‘beyond the ivory tower’, get out of our ‘air conditioned offices’ and embrace participatory action research. Madlingozi defines the latter as field research where the researcher interacts and participates with communities and engages in research that is ‘unashamedly’ political. Anton Kok in response takes what he calls a ‘pragmatic instrumentalist’ view in contrast to Madlingozi’s more ‘ambitious critique’. Focusing more on law’s potential he highlights the areas where law could contribute to transformation. Both colleagues are not afraid to put their personal political/ideological views on the table. In this way they contribute to the vision of creating a space for dialogue, dissent, creativity and re-imaginings. About the authors: Mr Tshepo Madlingozi works at the Department of Legal History, Comparitive Law and Jurisprudence, Faculty of Law, University of Pretoria. Joel Modiri and Emile Zitzke (both second years in 2011), after reading the dialogue between Heyns and Van Marle last year as first year students coming into the faculty of law were prompted to revisit some of the issues raised. Heyns and Van Marle’s dialogue was in response to a decision of the Centre for Human Rights not to display a group of etchings by Diane Victor from her Disasters of Peace series in their offices and a subsequent decision of the University’s management, taken after the group of etchings had been moved to the Department of Public Law, to remove two of the etchings that were found to be most offensive by a group of complainants including the then principal of the University, Prof Calie Pistorius. Six years after the removal of these art works Modiri and Zitzke bring fresh perspectives to the debate. Added to this edition also is a musing by Prof Christof Heyns. The original idea with Pulp fictions was to open spaces for discussion, dialogue and dissent and opportunity for creativity, experimentation and reimaginings. Over the past 6 years, colleagues from the UP Faculty of Law; from other faculties in UP; and from other universities have participated, as have a judge of the Constitutional Court and an attorney. This is the first edition in which students have entered these spaces. We welcome this expansion and reiterate previous calls for more participation from the UP academic community and beyond. This book focuses on the knowledge area of higher education governance, organisational dynamics, leadership and decolonisation. We have observed that governance discourse has been excluded in debates that concern the public good. The construct of public good seeks to support higher education that does not support a capitalist view of profit-making, arguably to respond to societal demands and needs such as developmental efforts through academic functions. Higher Education focuses on interconnected multi-disciplinary constructs, intending to provide services for the public good. The issue of public good is an interesting construct that puts universities on the spot since they are expected to be responsive to environmental changes and stakeholder needs through the functioning of accountable governance structures. These governance structures are compelled to comply with policy demands within external and internal environmental factors. This experience has exposed universities to systematic challenges that are local, regional and global, and which forces them to adapt while serving stakeholders and society. Many countries around the world are engaged in decentralization processes, and most African countries face serious problems with forest governance, from benefits sharing to illegality and sustainable forest management. This book summarizes experiences to date on the extent and nature of decentralization and its outcomes, most of which suggest an underperformance of governance reforms, and explores the viability of different governance instruments in the context of weak governance and expanding commercial pressures over forests.
