Legal Theory, Sources of Law and the Semantic Web is an attempt to construct an integrated conceptual framework for the application-neutral and problem-neutral representation of sources of law using Semantic Web technology and concepts, and some technically straightforward extensions to Semantic Web technology based on established practices found in fielded applications. To construct this framework, the author disentangled some problems that are often mixed up in legal theory and – in extension – legal knowledge representation. The purpose of this framework is to provide a theoretical background for the creation of reusable and maintainable knowledge components representing knowledge of sources of law on the Semantic Web. These components should form a basis for the development for computer applications supporting straightforward, routine decision making problems using traditional methods. This book aims to be a work of ontology: an account of relevant aspects of the knowledge domain of law from the perspective of a legal knowledge engineer interested in sources of law. One cannot however say that the result of this work is an ontology: this book presents a mix of design principles, design patterns for knowledge representation in OWL DL and ontology fragments.

Investor-State arbitration is currently a much-debated topic, both within the legal community and in the public at large. In Towards Consistency in International Investment Jurisprudence, Katharina Diel-Gligor addresses the alleged proliferation of inconsistent decision-making in this field – one of the main points of concern raised in the ongoing discussions. After exploring whether such criticism is appropriate at all, she goes on to examine the different causes, forms, and manifestations of the inconsistencies that exist through a detailed analysis of ICSID arbitration. The author then canvasses possible approaches to reform and concludes that an ICSID preliminary ruling system – the practicalities of which are set out in the study – is a suitable means for enhancing consistency in investment arbitration and moving towards a jurisprudence constante.

The inspiring idea of this workshop series, Artificial Intelligence Approaches to the Complexity of Legal Systems (AICOL), is to develop models of legal knowledge, concerning organization, structure and content, in order to promote mutual understanding and communication between different systems and cultures. This comparative philosophy of law book aims at formulating a new analytical approach to the Islamic legal tradition based on ‘juridical categories’, a concept that facilitates comprehension and understanding of juridical phenomena. Building upon legal comparativism and legal pluralism, this project intends to avoid bias caused by universalizing Western categories when analyzing foreign juridical notions, which inevitably results in the miscomprehension of non-Western ideas and institutions. Unlike existing literature, this project will not focus on substantive comparisons between normative contents, but on the ‘juridical perspectives’ that helped to shape the Islamic and Western legal orders.The book focuses on the most relevant juridical questions regarding the Islamic and Western legal perspectives, such as the different visions regarding juridical spatiality, the role of human reason and the relationship between law, man and the divinity.
