Beyond civil disobedience and the citizen's power to protest and defy law, this book looks at rule departures actually sanctioned by law. This acclaimed study by philosophy professor Mortimer Kadish and law professor Sanford Kadish is a truly interdisciplinary inquiry into the idea of departing from the strict letter of the law in a way that, they argue, actually comports with both law and morality. An instant classic and source of debate when first published by Stanford University Press in 1973, this book still resonates on questions of rule violations for the greater good, jury nullification, police and prosecutor discretion not to arrest or charge, civil disobedience, and the very concept of rules. Both citizens and government actors, they write, hold the power and the right to deviate from law in certain contexts and yet not act illegally in a sense -- because law itself contains strands of adaptations to its own departures that the authors weave into a sustained jurisprudential point. As one reviewer soon wrote, "the paradoxical idea that a citizen or official may lawfully break the law" will surely "raise the hackles" of any legal positivist. Yet it remains a challenging idea well worth considering. This book, despite its reputation in the fields of law and philosophy, is actually accessible to fields and scholars beyond, and to citizens who are finding their rightful place among the powers of governmental institutions.Part of the Classics of Law & Society Series from Quid Pro, includes 2010 Notes by the series editor and is available in new high-quality digital formats as well.

Seminar paper from the year 2013 in the subject Law - Public Law / Constitutional Law / Basic Rights, grade: 80, University of South Africa, language: English, abstract: The principal objective of this paper is to critically analyse how the post-1994 South African government has reacted to civil disobedience, when it is the very tool that has played a large role in bringing them to power. The new rainbow nation has had unarmed confrontation with the State in areas of racial harmonisation, socio-economic issues and unreasonable governmental policies. While acknowledging that civil disobedience is at cross purpose with the law, the paper establishes that civil disobedience and the rule of law should be balanced in a healthy democracy. The citizenry should be made aware of its rights and obligations imposed by the constitution. On the other hand, the State’s response to civil disobedience should be one enveloped in legal authority. Thus civil disobedience in any democracy should not be met with a knee jerk reaction. The paper also scrutinizes the divergent views on law and morality. Divergent as they are, the common denominator is that no society can do without intoleration, indignation and disgust which in the end may lead to civil disobedience. This study will define the concept civil disobedience and rule of law. The link between civil disobedience and the rule of law shall be explained through theories of legal positivism and natural law in particular the Hart-Devlin debate and the Hart-Fuller debate.

This volume seeks to disentangle the limits and possibilities of the tradition of civil disobedience: in what circumstances is it right, or perhaps necessary, to say "no"? The jurisprudential and philosophical literature discussed here is truly enormous and provides a complex and reliable overview of the main problems.

Civility And Disobedience written by Burton Zwiebach and has been published by Cambridge University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 1975-06 with Political Science categories.

Originally published in 1975, this book seeks to examine the problem of political obligation: when are we obligated to obey the laws? It presents a critique of traditional justifications of obligation - especially of social contract theory - and attempts to develop a fresh theory of obligation as both justified and limited by the need to substitute the culture of civility for the violence and barbarism of pre-political society. Civility, it is argued, can be attained by the creation of a common political life, characterised by equality, liberty, participation, and accountability of public authority. Dr Zwiebach's argument on behalf of a broadened conception of civility and disobedience was a significant contribution to the important dialogue on political obligation, on a more civilised notion as 'common life', on 'right', 'politics', and on the strengths and weaknesses of the theory and practice of liberalism.

Civil Disobedience written by Henry David Thoreau and has been published by Open Road Media this book supported file pdf, txt, epub, kindle and other format this book has been release on 2015-05-26 with Philosophy categories.

Thoreau advocates for nonviolent protest in his classic manifesto Motivated by his disgust with the US government, Henry David Thoreau’s seminal philosophical essay enjoins individuals to stand against the ruling forces that seek to erase their free will. It is the duty of a good citizen, he argues, not only to disobey a bad law, but also to protest an unjust government. His message of nonviolence and appeal to value one’s own conscience over political legislation have resonated throughout American and world history. Peppered with the author’s poetry and social commentary, Civil Disobedience has become a manifesto for civil dissidents, revolutionaries, and protestors everywhere. Indeed, originally so unpopular with readers that Thoreau was forced to buy back over half of the books from his publisher, this work has gone on to inspire the likes of Mahatma Gandhi and Martin Luther King Jr. This ebook has been professionally proofread to ensure accuracy and readability on all devices.
