This unique volume offers a survey of legal and legislative means to combat racism, xenophobia, anti-semitism and other forms of related intolerance. Its aim is threefold: 1) to provide a legal model for fighting racism, xenophobia, anti-semitism and discrimination through domestic legislation; 2) to compare existing national legislation with international legal instruments designed to combat racial and other forms of discrimination, in order to bring domestic laws into line with international legal norms; 3) to provide a tool for researchers, legislators, human rights activists and all those who work to protect the rights of minorities and victims of incitement and discrimination, as well as for domestic and international institutions, which monitor compliance with these laws. In the last two decades many countries have recognized the existence of widespread and persistent discrimination against women and racial minorities, and have sought to reduce or eliminate discrimination through legislation. In this book Jeanne Gregory examines the British experience in using the law to reduce inequality and assesses what has been done and can be achieved in this way. In Britain, the passing of the Sex Discrimination Act 1975 and the Race Relations Act 1976 gave victims of discrimination direct access to the tribunals and courts for the first time, and created two new Commissions with wide-ranging powers. In assessing how far these laws have been successful, Jeanne Gregory offers a clear, forceful analysis of the issues and problems raised by equal rights legislation. She concentrates on the key employment provisions, and compares the British experience with that of equal rights legislation elsewhere, particularly in the USA. This collection of essays arose from a conference held to mark the silver anniversary of the Australian Sex Discrimination Act (1984). The collection has two aims: first; to honour the contributions of both the spirited individuals who valiantly fought for the enactment of the legislation against the odds, and those who championed the new law once it was passed; secondly, to present a stock-take of the Act within the changed socio-political environment of the 21st century. The contributors present clear-eyed appraisals of the legislation, in addition to considering new forms of legal regulation, such as Equality Act, and the significance of a Human Rights Act. The introduction of a proactive model, which would impose positive duties on organisations, is explored as an alternative to the existing individual complaint-based model of legislation. The contributors also pay attention to the international human rights framework, particularly the Convention on the Elimination of all Forms of Discrimination against Women and the UN Declaration on the Rights of Indigenous People. The essays are illuminated by recourse to a rich vein of historical and contemporary literature. Regard is also paid to the comparative experience of other jurisdictions, particularly the UK and Canada.
