The Commission's report examines the options for ensuring adequate post-legislative scrutiny of Acts of Parliament, in the light of the recommendation of the House of Lords Select Committee on the Constitution (in their 14th report, HCP 173-I, session 2003-04; ISBN 0104005416). The main focus of the report is on primary legislation, but it also considers delegated legislation and European legislation. Issues discussed include: existing forms and benefits of post-legislative scrutiny in the UK Parliament and in other jurisdictions (including Canada, Australia, Germany, France and the EU); the experience of pre-legislative scrutiny; and options for post-legislative scrutiny mechanisms. The Public Bodies Bill (HL Bill 25, ISBN 9780108478765) proposes to create a number of delegated powers by which the Government can abolish, merge, modify the constitution, functions or budgetary arrangements or a body or authorise delegation of a body's functions to a third person or body. Several other committees have expressed concern about the extreme breadth of the delegated powers proposed, and this report outline's three significant human rights issues arising from the Bill. First is the independence and impartiality of bodies protecting and promoting human rights. The inclusion of bodies such as the Equality and Human Rights Commission, the Children's Commissioner, the Inspectorate of Prisons and the Legal Services Commission in the schedules to the Bill may undermine their functional or perceived independence. Secondly, the Committee is concerned that the abolition or reform of other bodies which serve a particular decision making function may undermine the right to procedural fairness. Thirdly, the breadth of delegation proposed in the Bill appears wholly inappropriate, and the excessive use of delegated powers may reduce the effectiveness of parliamentary scrutiny for human rights compatibility of proposed legislation.

The Constitutional Reform and Governance Bill was re-introduced in the House of Commons on 19 November 2009 and the Committee welcomes a number of aspects of the Bill which is implementing some of the commitments made by the Prime Minister in his Governance of Britain statement in July 2007. But the Committee considers there are a number of significant omissions from the Bill including in relation to judicial appointments, parliamentary scrutiny of security and intelligence matters, and the restrictive judicial interpretation of the meaning of public function in the Human Rights Act. They recommend amendments relating to the latter two points. They also look at Protest around Parliament, Ratification of Treaties and Right to a fair hearing and access to a court in the determination of civil rights.The Video Recordings Bill was introduced into the House of Commons on 15 December 2009 and is a fast track piece of legislation which repeals and revives the provisions of the Video Recordings Act 1984 in order to enable them to be notified to the European Commission under the Technical Standards Directive and so secure its enforceability. The Committee considers the human rights issues raised by this Bill should be subjected to parliamentary scrutiny. However as the 1984 Act, serves as an important child protection purpose, that are currently unenforceable, the Committee accepts the need for fast tracking this legislation and does not propose to further scrutinise this Bill.

This report welcomes the enhanced human rights protection which the Protection of Freedoms Bill (HC 189, ISBN 9780215558091) would provide, by proposing to repeal or reform measures which impinge on rights and freedoms. But this protection should be strengthened further in some areas. The Committee welcomes the Government's review of existing powers of entry to private properties, including homes, which has identified around 1200 statutory powers with associated powers of entry. But it is deeply concerned that the proposed breadth of proposals in the Bill could create new risks to individual rights by authorising the Government to extend existing powers of entry. The provisions relating to biometric material create a less intrusive mechanism for the retention of DNA and fingerprints. However, the Bill creates some unjustified risks to the individual right to privacy and the Government should provide further justification or amend the Bill significantly. There should be new safeguards in relation to the processing of children's biometric information. The Committee welcomes the proposal for a surveillance code to regulate the operation of CCTV by public authorities, and the permanent reduction in the maximum period of pre-charge detention of terrorist suspects to 14 days. However, it questions whether the need to provide for a contingency power to extend the period of pre-charge detention in the event of a future emergency is supported by the evidence. The Committee also supports changing the Public Order Act 1986 to remove all reference to public order offences based upon insulting words or behaviour.

The Committees report examines parliamentary scrutiny of legislation, focusing on the process for dealing with primary legislation (i.e. the scrutiny of parliamentary bills). This examination is carried out in the light of the Rippon Commission report on the topic (Making the Law produced by the Hansard Society Commission on the Legislative Process) which was published in 1992. Topics discussed include the mechanisms for pre-legislative and post-legislative scrutiny, the growth of legislation, the dissemination of information and ways of gauging public opinion through consultation. Conclusions drawn by the Committee include concern over the growth in the number and complexity of bills being presented to Parliament without adequate expansion in the capacity to deliver effective scrutiny. The report contains a number of proposals designed to help engender a culture shift away from this unsustainable volume of legislation, towards a culture of justification which encourages government to adopt a more disciplined approach to the introduction of bills based on the objective of effectiveness rather than quantity.
