El Derecho penal está inmerso, desde hace décadas, en una tendencia expansiva. Hacia dentro del sistema, se crean nuevos delitos, se agravan las escalas penales, se flexibilizan las reglas de imputación y se relativizan garantías. Actualmente y hacia fuera, crecen las expresiones propias de una supuesta paralela: linchamientos, escraches, cultura de la cancelación, etc. Para hacer frente al fenómeno expansivo, es necesario recuperar el diálogo entre la dogmática jurídico-penal y el Poder Judicial, insistiendo en que la función social del académico radica en proporcionar nuevas herramientas que permitan a los jueces hacer mejor su trabajo: separar, de forma justa, los hechos punibles de aquellos que no son ni deben ser punibles. No obstante, debe reconocerse también que la dogmática -entre otras cosas- no ha logrado sistematizar todo aquello que, una vez cometido el delito, afecta la posibilidad de ejercer (o la intensidad con que se ejerce) la facultad punitiva del Estado. En este campo trazan surcos las líneas de esta monografía: aquí se pretende aminorar esa deficiencia mediante la construcción y puesta a prueba de una teoría general de los equivalentes funcionales de la pena retributiva; esto es, un modelo que permite asignar, de forma sistemática y segura, consecuencias jurídicas a diferentes institutos del Derecho penal, estén o no contemplados en la contingente legislación moderna. Para la construcción del modelo y en el primer bloque de contenidos, se utilizan tres herramientas básicas. La primera, un sistema bipartito del hecho punible que, construido sobre la base de una teoría dualista de las normas, permite mantener lo sistemático de la teoría del delito a nivel de injusto culpable (antinormatividad) y, al mismo tiempo, proporcionar criterios nuevos en el campo del hecho punible (sancionabilidad). La segunda, adoptar una teoría retributivo-comunicativa de la pena en el marco una concepción del Derecho como praxis efectivamente practicada. La tercera, el método comparativo del funcionalismo de las equivalencias. Delineado el modelo, el bloque segundo pone a prueba su capacidad de rendimiento a través del análisis detallado de tres institutos clave: el desistimiento de la tentativa, la regularización tributaria y la atenuante de confesión. Según la opinión de Jesús-María Silva Sánchez y Omar Palermo, directores de la investigación y prologuistas del libro, se trata de «la primera monografía -en cualquier lengua que tiene por objeto la elaboración de una teoría de los equivalentes funcionales de la pena»; «una gran obra de filosofía del Derecho penal y de dogmática de la teoría del delito» y, en definitiva, «un extraordinario libro de Derecho penal; aquí y allá; antes y ahora».

The book tries to identify the main contours of unjusticiability and non-justiciability from an historical and comparative perspective distinguishing between common law world and civil law tradition. In the light of a general overview, the aim of this publication is to reflect on the utility of paving the way for a much wider approach to unjusticiability. More precisely, some scholars have recently suggested that such a notion could embrace all the situations where a court does not decide a case, so that it is impossible for the plaintiff to have the case decided by a court. A first category covers the situations where the court refuses to judge because it does not want to judge. A second category is related to all the cases where there is an impossibility to reach a decision. Any case where the judge cannot or does not wish to make justice--si iudex non facit iustitiam--continues to indicate a series of new (and old) questions.
