Das Interesse an den allgemeinen Fragen des Rechtes des Staates, des sozialen Lebens hat sich weithin verbreitet und vertieft; und es liegt eine Fulle bemerkenswerter Aus fuhrungenuber diesen Gegenstand vor. Es fehlte aber bis jetzt an einer Zusammenfassung und ubersichtlichen Darstellung furden, der sich uber das Ganze der rechtsphilosophischen Lehre unterrichten mochte. Die damit gestellte Aufgabe stimmt in ihrer Art durchaus mit dem Plan uberein, den zahlreiche ausgezeichnete Lehrbuche1 auf allen an deren Gebieten der Rechtswissenschaft verfolgen. Im besonderen kann hier immer vorbildlich die Weise bleiben, in der seiner Zeit Wind s c h e i d sein unubertroffenes Lehrbuch des Pandektenrechtes bearbeitet hat. In gleichem Sinne will auch das folgende Lehrbuch zuvorderst jedem dienen, der mit der Rechtsphilosophie noch nicht vertraut ist und sich ihr nun uberhaupt erst nahern will; aber doch auch demjenigen genauere Hilfe bieten, der eine eindringliche Untersuchung eines Problems wunscht. Die hierzu erforderlichen literarischen Angaben bereiten manche Schwierigkeit. Das rechtsphilosophische Schrifttum ist sehr verstreut. Manches wird dem Verfasser entgangen sein; und uber die von ihm ge troffene Auswahl wird nach Anfuhrung und Berucksichtigung zuweilen Verschiedenheit der Ansichten herrschen konnen. Selbstredend aber war es angezeigt, tunlichst solche Bucher und Schriften anzugeben, aus denen der Leser weitere Nachweisungen erhalt.
