No regime de economia de mercado, a livre concorrência é um importante princípio para a materialização dos objetivos da República Federativa do Brasil, com destaque para a construção de uma sociedade livre, justa e solidária. As raízes legais do direito da concorrência estão nos Estados Unidos e na Europa. Como as primeiras legislações norte-americanas combatiam os trustes, a disciplina é comumente conceituada como direito antitruste, apesar da inexistência dessa organização empresarial no Brasil. A evolução do direito da concorrência no País ocorreu após a Constituição de 1988, principalmente com a Lei n° 8.884/94, que transformou o Conselho Administrativo de Defesa Econômica em autarquia e normatizou a prevenção e repressão ao abuso do poder econômico. Em novembro de 2011 foi sancionada a Lei n° 12.529, que estruturou o Sistema Brasileiro de Defesa da Concorrência, formado pelo Conselho Administrativo de Defesa Econômica - CADE e pela Secretaria de Acompanhamento Econômico do Ministério da Fazenda.
