Cet ouvrage de référence, destiné en particulier aux chercheurs et aux praticiens du droits, traite la matière de façon approfondie et s’appuie sur un ensemble impressionnant de références à la pratique décisionnelle, à la jurisprudence et à la doctrine. EXTRAIT La notion de compétences est au cœur du système communautaire et, aujourd’hui, de l’Union européenne. Mais sa prise en compte par les traités ne s’est faite que progressivement jusqu’au traité de Lisbonne. La Cour de justice des Communautés européennes, spécialement à propos des compétences externes, a pallié les lacunes du traité CEE et a levé ses approximations. Elle a ainsi érigé un véritable système des compétences externes dont on trouve un exposé particulièrement éclairant dans l’avis 2/94. Pour tout accord que la Communauté européenne entendait conclure, il était donc nécessaire de procéder, sur la base des possibilités offertes par le traité et précisées par la jurisprudence, à une identification de la compétence communautaire du point de vue de son existence et de son étendue dans un premier temps, puis de sa nature dans un second temps, afin de savoir si la Communauté pouvait s’engager au plan international et si oui, seule ou avec ses États membres. 2. Le traité de Lisbonne apporte des nouveautés importantes en matière externe : le traité sur l’Union européenne (TUE) comporte notamment, à l’article 21 TUE, un énoncé des principes et objectifs que l’Union européenne, qui succède à la Communauté européenne et dispose expressément de la personnalité juridique, devra respecter dans l’ensemble de son action extérieure et le traité sur le fonctionnement de l’Union (TFUE) prévoit désormais une cinquième partie spécifique intitulée « L’action extérieure de l’Union », dont est cependant exclue la politique étrangère et de sécurité commune (PESC). Celle-ci, traitée dans le TUE, conserve son particularisme institutionnel en dépit de la disparition des piliers. Du point de vue des compétences plus précisément, le traité de Lisbonne adopte également « une démarche tout à fait nouvelle par rapport aux traités initiaux » en procédant à une systématisation qui touche les compétences internes mais aussi externes dans la mesure où, comme l’avait relevé la Cour, « le respect de ce principe des compétences d’attribution s’impose tant pour l’action interne que pour l’action internationale ». Toutefois, s’agissant des compétences externes, certaines particularités largement inspirées par les acquis jurisprudentiels complètent le dispositif général.
