In Levels of Argument, Dominic Scott compares the Republic and Nicomachean Ethics from a methodological perspective. In the first half he argues that the Republic distinguishes between two levels of argument in the defence of justice, the "longer" and "shorter" routes. The longer is the ideal and aims at maximum precision, requiring knowledge of the Forms and a definition of the Good. The shorter route is less precise, employing hypotheses, analogies and empirical observation. This is the route that Socrates actually follows in the Republic, because it is appropriate to the level of his audience and can stand on its own feet as a plausible defence of justice. In the second half of the book, Scott turns to the Nicomachean Ethics. Scott argues that, even though Aristotle rejects a universal Form of the Good, he implicitly recognises the existence of longer and shorter routes, analogous to those distinguished in the Republic. The longer route would require a comprehensive theoretical worldview, incorporating elements from Aristotle's metaphysics, physics, psychology, and biology. But Aristotle steers his audience away from such an approach as being a distraction from the essentially practical goals of political science. Unnecessary for good decision-making, it is not even an ideal. In sum, Platonic and Aristotelian methodologies both converge and diverge. Both distinguish analogously similar levels of argument, and it is the shorter route that both philosophers actually follow - Plato because he thinks it will have to suffice, Aristotle because he thinks that there is no need to go beyond it.

This book is a revised version of my dissertation 'DiaLaw - on legal th justification and dialog games' that I defended on June 5 1998 at the Universiteit Maastricht. The chapters 1, 4 & 5 (now: 1, 5 & 6) of my dissertation have remained largely unaltered. In chapter 2 I added explicitly the distinction between constructing legal justification and reconstructing it, and tried to elucidate the differences (and similarities) between the product and process of justification. Chapter 3 is divided into two chapters: one on the general characteristics of DiaLaw (now: chapter 3), and the other on specific, legal characteristics of DiaLaw (now: chapter 4). In order to improve readability, all rules in these chapters have been rewritten considerably. The section on the implementation of DiaLaw is moved to the appendix. In chapter 7 (the former chapter 6), a discussion of the notions 'procedural' and 'structural' arguments is added, and different layers in argumentation models are discussed. Finally, in chapter 8 (the former chapter 7) is added a recapitulation of my view on legal justification, and a discussion on the future use in legal practice of dialog models that represent argumentation in a natural way. The main thesis has remained unaltered: legal justification should be modeled as a procedural, dialogical model in which not only products of argumentation are allowed, but, even in formal models, rhetorical, psychological aspects of argument are dealt with.

The concept of semantic roles has been central to linguistic theory for many decades. More specifically, the assumption of such representations as mediators in the correspondence between a linguistic form and its associated meaning has helped to address a number of critical issues related to grammatical phenomena. Furthermore, in addition to featuring in all major theories of grammar, semantic (or 'thematic') roles have been referred to extensively within a wide range of other linguistic subdisciplines, including language typology and psycho-/neurolinguistics. This volume brings together insights from these different perspectives and thereby, for the first time, seeks to build upon the obvious potential for cross-fertilisation between hitherto autonomous approaches to a common theme. To this end, a view on semantic roles is adopted that goes beyond the mere assumption of generalised roles, but also focuses on their hierarchical organisation. The book is thus centred around the interdisciplinary examination of how these hierarchical dependencies subserve argument linking - both in terms of linguistic theory and with respect to real-time language processing - and how they interact with other information types in this process. This book is a systematic exposition of Argument Dialectics (AD). Despite its name, argument dialectics is a logical approach to argumentation theory. AD stands out among theories of argument because of three unusual features: it is reasons-based, holistic and particularistic. This implies that AD conceives of logic as a theory of the dialectical construction of reasons, not as a theory of inferences. Consequently, contrary to other logical approaches, AD focuses on the study of inter-argumentative relations, especially those of opposition and weighing. The book makes an extensive use of the theory of reasons, a branch of metaethics that has been a very valuable quarry of intuitions and concepts for the elaboration of a reason-based theory of argument. The oppositions generalism-particularism and atomism-holism, proposed by Jonathan Dancy, which play a central role in the book and in the development of AD, have been adapted from the theory of reasons, and the same can be said of the distinction between different statuses of reasons that AD associates with different kinds of counterarguments. Conceiving of the theory of argument in terms of reasons has the effect of situating the paradigm of argumentation in practical argumentation/reasoning “about what to do” rather than in theoretical argumentation “about what to believe”, as inference-based theories do. Hence, this book is of interest to argumentation theorists, communication theorists, epistemologists, linguists, moral philosophers, and philosophers of law.
