La nueva ley de jurisdicción voluntaria (Ley 15/2015) de 2 de julio, pretende dar respuesta a un problema ya “crónico”, en la administración de justicia española, la agilidad en los procedimientos y el interés del ciudadano, que como explica la exposición de motivos de la ley, a lo largo de su articulado se establecen instrumentos sencillos, efectivos y adecuados a la realidad social a la que se aplican, en el caso de que se requieran la intervención de los Tribunales de justicia a través de cualquiera de los actos de jurisdicción voluntaria. El texto legal que es objeto de desarrollo y pormenorizado comentario, en esta obra colectiva, pretende –como se ha argumentado con buen criterio– deslindar aquellos ámbitos en los que aun no ejerciéndose jurisdicción; sin embargo existe la necesidad de una especial protección de determinados derechos, en cuyo caso el juez es quien debe tutelar el expediente. Separadas tales materias, la tutela de cualquier otro derecho que se resuelva a través de un expediente de jurisdicción voluntaria exige la participación de quien ejerce. “autoridad pública”, para lo que es precisa la existencia de un funcionario público. Estudio pormenorizado de la nueva Ley de Jurisdicción voluntaria en el que más de 90 autores analizan, artículo por artículo, las principales novedades que introduce la reforma.
