El presente estudio sobre nacionalidad aborda la normativa vigente sobre este sector del ordenamiento jurídico español. La actualidad e importancia del mismo radica en que la nacionalidad es una materia que afecta de lleno al fenómeno migratorio. En el derecho español se reflejan dos fenómenos intensos: el de la emigración española, que ha llevado a que se establezcan sistemas de transmisión de nacionalidad por el llamado ius sanguinis, y el de la inmigración, que permite diferentes posibilidades de acceso a los residentes en territorio español. Con este Libro se trata de dar la máxima publicidad de las normas españolas relativas a este sector, incluida la Disposición Adicional 7a de la Ley 52/2007, de 26 de diciembre, por la que se reconocen y amplían derechos y se establecen medidas en favor de quienes padecieron persecución o violencia durante la guerra civil y la dictadura -Ley de la Memoria histórica-., que incorpora nuevos supuestos de acceso a la nacionalidad española, mediante los cuales los hijos de emigrantes de origen español y los nietos de los exiliados podrán optar por la nacionalidad española de origen desde el 27 de diciembre de 2008 hasta el 27 de diciembre de 2010. La obra comienza con una referencia al concepto y a las fuentes del Derecho español de la nacionalidad y se examinan en los seis capítulos siguientes la totalidad de las instituciones relativas a la nacionalidad. Todas ellas son tratadas a través de la explicación minuciosa de los casos prácticos que han ido surgiendo y que han sido resueltos por las autoridades judiciales y por la Dirección General de Registros. En definitiva, la monografía consigue informar exhaustivamente sobre el actual derecho español de la nacionalidad así como de su interpretación. Además, este estudio incluye unos mecanismos de ayuda en la tramitación de los expedientes sobre nacionalidad, al contar con un Anexo Legislativo que se completa con el Anexo relativo a los fundamentales formularios. Por tanto, el análisis de la normativa vigente sobre nacionalidad tiene un interés eminentemente práctico al tiempo que se realiza un análisis completo del carácter teórico del vigente derecho español de la nacionalidad.
