Durante el periodo democratico que rigio en Venezuela desde los anos sesenta hasta comienzos del presente siglo, el derecho administrativo adquirio una conceptualizacion propia de un regimen juridico destinado a regir una Administracion de un Estado de derecho, que no solo busco regular las prerrogativas y potestades de la misma, sino los derechos de los Administrados en relacion con los administrados. Ese desarrollo equilibrado se debio, no solo al impulso doctrinal que recibio la disciplina desde esos anos iniciales de la democracia con la publicacion, casi simultanea, por ejemplo, de los libros del profesor Eloy Lares Martinez (Manual de Derecho Administrativo, Caracas 1993) y del profesor Allan R. Brewer-Carias (Las Instituciones Fundamentales del Derecho Administrativo y la Jurisprudencia Venezolanas, Caracas 1964), sino al extraordinario aporte que hicieron los tribunales de la jurisdiccion contencioso administrativa, mientras pudieron decidir con autonomia e independencia, al controlar a la Administracion y garantizar los derechos de los administrados ante las ilegalidades o arbitrariedades de la misma. Esa combinacion de la doctrina y la jurisprudencia libremente desarrolladas en democracia, fue la que permitio que el regimen juridico de la Administracion, no solo se hubiera constitucionalizar, sino que hubiera podido encontrar la extraordinaria positivizacion que se plasmo en el conjunto de leyes basicas del derecho administrativo, que son las que conforman este Codigo de Derecho Administrativo. Esas leyes fundamentales, que son las que publican en este libro, son las siguientes: 1. La Ley Organica de la Administracion Publica; 2. La Ley del Estatuto de la Funcion Publica; 3. La Ley Organica de Procedimientos Administrativos; 4. La Ley de Contrataciones Publicas; 5. Ley Organica sobre promocion de la inversion privada bajo el regimen de concesiones; 6. La Organica de la Administracion Financiera del Sector Publico; 7. La Ley de Bienes Publicos; 8. La Ley contra la Corrupcion; 9. La Ley Organica de la Contraloria General de la Republica y del Sistema de Control Fiscal.; y 10. La Ley Organica de la Jurisdiccion Contencioso Administrativa. A pesar de que la efectividad y aplicacion de muchas de estas leyes, ciertamente haya quedado en entredicho por el desarrollo progresivo durante los primeros anos del siglo XX de un gobierno autoritario, al margen de la Constitucion, ello sin embargo no le quita el valor que tienen dichas leyes para el desarrollo de la disciplina del derecho administrativo, al mostrar el progreso que este puede alcanzar en un regimen democratico como el que permitio su sancion.
