La Ley Orgánica 6/2002, de 27 de junio, de Partidos Políticos introdujo un novedoso mecanismo de disolución que, gracias al consenso de las fuerzas políticas mayoritarias por aquel entonces, se reveló como un medio muy eficaz para frenar el apoyo a diversas formas de violencia del entramado de Batasuna.A pesar de su amplia denominación, la LOPP se mueve en el terreno de una legislación constitucional de emergencia que se pensó para poner fin a muchos años de violencia terrorista. Sólo desde ese contexto sociológico, puede comprenderse esta ley antes de analizarla con los matices, exigencias e interpretaciones garantistas formuladas por el Tribunal Constitucional.El autor señala que las actividades externas de los partidos políticos deben adecuarse intensamente -y no sólo en su organización interna- a los valores, principios democráticos y derechos fundamentales{ de forma que se les podría disolver cuando vulnerasen estos principios o pretendieran destruir el sistema de libertades mediante el fomento de la violencia como supuesto método para conseguir objetivos políticos o el apoyo a la acción de organizaciones terroristas.Podría decirse que no cabe transformar el orden constitucional por medios ilegales. El partido que apoye la violencia -o la practique- está poniendo en peligro la subsistencia del orden pluralista constitucional y es razonable que el Estado se defienda y lo excluya de los beneficios que otorga a estas asociaciones.El libro analiza los problemas jurídicos que han surgido desde entonces y cuáles son sus soluciones: disolución de grupos en los parlamentos autonómicos, liquidación de los bienes patrimoniales de un partido disuelto, la sucesión de partidos ilegalizados por otros "partidos de cobertura", etc. Un esfuerzo jurídico que debe formar parte de una adecuada política de Estado -no de Gobierno- compartida por todas las fuerzas políticas y alejada de la confrontación electoral.

This edition of the Inter-American Yearbook on Human Rights , like the volumes that precede it, includes information concerning the activities of the Organization of American States in the promotion & protection of human rights. It begins with the composition of the Commission & Court, including the biographies of the members, 1988 activities of each body, reproductions of resolutions & reports by the Commission & historic correspondences & decisions by the Court. Also included is an update on the status of the American Convention on Human Rights, which reports the relation of each country to that instrument, followed by resolutions adopted in 1988 by the OAS General Assembly. The year 1988 distinguished itself particularly because the Inter-American Court of Human Rights made its first decision on a contentious case, the Velásquez Rodríguez case (Honduras). This historic decision is reproduced in Part Three of this volume. Another important 1988 development in the Inter-American system was the Protocol of San Salvador, or Additional Protocol to the American Convention on Human Rights for Economic, Social & Cultural Rights, reproduced in Part Four. Also included, in its entirety, is a report on the human rights situation in Haiti, a report requested by the Organization of American States Permanent Council in Resolution 502. The Inter-American Yearbook on Human Rights is completely bilingual (English & Spanish).
