Censura, Justiça e Regulação da Mídia na Redemocratização avalia as transformações nas instâncias judiciais de controle da liberdade de expressão após a abertura democrática brasileira e a proibição constitucional da censura, no fim dos anos 1980. Ao rebaixar o controle estatal da comunicação, a Constituição Cidadã acabou inversamente por reforçar a proteção de interesses privados, que resistem à regulação da mídia longe do escrutínio público. Considerando que muitos congressistas que deveriam legislar sobre os meios de comunicação são eles mesmos donos de jornais, rádios ou televisões, muitas propostas de lei que procuravam delimitar direitos e deveres para a mídia e seu público foram sistematicamente tolhidas. Sem o debate coletivo no Legislativo, resta o apelo ao conflito de interesses particulares no Judiciário. Esse cenário acabou sendo complicado pela nova Constituição, que apontava direitos em frequente colisão, como a liberdade de expressão e os direitos à privacidade, à imagem, à honra e tantos outros princípios que se chocavam sem regras muito claras para sua ponderação ou prevalência. Isso abriu espaço para a interpretação de juízes que acabam assumindo a responsabilidade por definir limites, punições e reparações, sempre caso a caso. Assim, um debate político acabou reduzido e canalizado ao embate legal, o que priva o público da sua influência sobre a discussão dos direitos à comunicação devido ao caráter nem sempre acessível das discussões judiciárias — em um processo em que o público se posiciona não como agente, mas como plateia dos debates feitos em seu nome. Para entender como a Justiça brasileira delimita a liberdade de expressão enquanto contempla demandas veladas de retorno à censura, este livro constrói um panorama sobre as limitações das atuais instâncias de regulação da comunicação, avaliando como suas recentes e respectivas formações (e limitações) foram afetadas pelo processo de abertura democrática. Nesse sentido, a obra avalia como o Supremo Tribunal Federal (STF) delimita ou evita o termo censura, um tabu constitucional, ao debater casos em que prevalecem argumentos progressistas e liberais contra o controle estatal, mas com frequente contraponto de uma proteção conservadora de direitos individuais que ainda se sobrepõem ao direito coletivo à comunicação.

This book examines democratizing media reforms in Latin America. The author explains why some countries have recently passed such reforms in the broadcasting sector, while others have not.
