In the wake of what has come to be called the ‘cultural turn’, it is often asked how the state should respond to the different and sometimes conflicting justice claims made by its citizens and what, ultimately, is the purpose of justice in culturally diverse societies. Building upon the work of a diversity of theorists, this book demonstrates that there is a distinct ‘epistemic’ tradition of liberalism that can be used to critique contemporary responses to cultural diversity and their underlying principles of justice. It critically examines multicultural, nationalist and liberal egalitarian approaches and argues that an epistemic account of liberalism, that emphasises social complexity rather than cultural diversity or homogeneity, is the most appropriate response to the question of justice in modern culturally diverse societies. During the 20th century many countries embarked on a process of constitutional secularization by which the role of religion gradually became limited. Yet, by the late 20th century, and increasingly following the end of the Cold War, this development began to be challenged. This book examines the return of religion in constitutions through the concept of constitutional de-secularization. It places this phenomenon in the context of the constitutional memory of the countries in which it has taken place and critically examines it against the development and standards of constitutionalism, as the prevailing constitutional legal and political theory. Central to this analysis is the impact of constitutional de-secularization on the regulation of equality in liberty, that is, both the regulation of constitutional rights and the scope for equality of those who are granted such rights. The book argues that equal liberty forms an essential part of constitutionalism as a theory, and that constitutionalism therefore entails a continuous development towards expanding it. The first and second part of the book presents a conceptual framework for the study of constitutional de-secularization. The third part presents and analyses three cases of constitutional de-secularization in Afghanistan, Iran and Iraq. The book will be of interest to researchers and policy-makers interested in constitutional history and theory, and the role of religion in law and its compatibility with human rights.

In this book, Duncan Kelly excavates, from the history of modern political thought, a largely forgotten claim about liberty as a form of propriety. By rethinking the intellectual and historical foundations of modern accounts of freedom, he brings into focus how this major vision of liberty developed between the seventeenth and the nineteenth centuries. In his framework, celebrated political writers, including John Locke, Montesquieu, Adam Smith, John Stuart Mill, and Thomas Hill Green pursue the claim that freedom is best understood as a form of responsible agency or propriety, and they do so by reconciling key moral and philosophical claims with classical and contemporary political theory. Their approach broadly assumes that only those persons who appropriately regulate their conduct can be thought of as free and responsible. At the same time, however, they recognize that such internal forms of self-propriety must be judged within the wider context of social and political life. Kelly shows how the intellectual and practical demands of such a synthesis require these great writers to consider freedom as part of a broader set of arguments about the nature of personhood, the potentially irrational impact of the passions, and the obstinate problems of individual and political judgement. By exploring these relationships, The Propriety of Liberty not only revises the intellectual history of modern political thought, but also sheds light on contemporary debates about freedom and agency.
