The most serious human rights problems during the year resulted from the absence of effective governance, justice, and security institutions, and abuses and violations committed by armed groups affiliated with the government, its opponents, terrorists, and criminal groups. Consequences of the failure of the rule of law included arbitrary and unlawful killings and impunity for these crimes; civilian casualties in armed conflicts; killings of politicians and human rights defenders; torture and other cruel, inhuman, or degrading treatment or punishment; and harsh and life-threatening conditions in detention and prison facilities.

This is the 2018 report on Human Rights by the U.S. Department of State published on March 13, 2019.Libya is a parliamentary democracy with a temporary Constitutional Declaration that allows for the exercise of a full range of political, civil, and judicial rights. Citizens elected the interim legislature, the House of Representatives (HoR), in free and fair elections in 2014. The Libyan Political Agreement, which members of the UN-facilitated Libyan political dialogue signed in 2015, created the internationally recognized Government of National Accord (GNA), headed by Prime Minister Fayez al-Sarraj. Political mediation efforts led by the United Nations aim to support passing a constitution and holding new elections to replace interim bodies that have governed Libya since the 2011 revolution with permanent state institutions.The government had limited effective control over security forces.Human rights issues included arbitrary and unlawful killings, including of politicians and members of civil society, by extralegal armed groups, ISIS, criminal gangs, and militias, including those affiliated with the government; forced disappearances; torture perpetrated by armed groups on all sides; arbitrary arrest and detention; harsh and life threatening conditions in prison and detention facilities, some of which were outside government control; political prisoners held by nonstate actors; unlawful interference with privacy, often by nonstate actors; undue restrictions on free expression and the press, including violence against journalists and criminalization of political expression; widespread corruption; trafficking in persons; criminalization of sexual orientation; and use of forced labor.

At year's end, a 38-day-old interim government began to exercise authority in Libya, formerly the Great Socialist People's Libyan Arab Jamahiriya. After eight months of civil war, ending with the ouster of the Qadhafi regime, construction of a republican form of government began. The opposition leadership in the Transitional National Council (TNC), which was formed on February 27, exercised executive authority prior to naming an interim government on November 23 and thereafter acted in a de facto legislative capacity as an arm of the government engaged in transition planning. Adopted by the TNC on August 3, Libya's Constitutional Declaration provides the basis of governance and allows for the exercise of a full range of political, civil, and judicial rights, including Article 3, which safeguards freedom of expression and assembly, and Article 8, the right to due process--rights that the Libyan people were systematically deprived of during Qadhafi's 42-year rule. While Qadhafi-era laws that did not contravene the declaration remained in force, the applicability of former laws remained unclear at year's end, due in large part to the absence of functioning courts. Although an indirect electoral system existed on paper under Qadhafi, in practice his inner circle monopolized all positions of power and security forces reported to them. During the conflict and in the brief period that followed until the end of the year, the TNC and later the interim government had yet to establish full political or military control over the country. In the 10-week period after the TNC declared the country's "liberation" on October 23, few security forces reported to the interim authorities, while militias acted sometimes in concert with government directives but did so more often autonomously.

The Gambia's constitution enumerates a full range of provisions and assurances for a multiparty democratic republic. Human rights organizations and opposition parties, however, claimed the government repeatedly took steps to restrict the democratic space. In 2011 voters reelected President Yahya Jammeh to a fourth term in a peaceful, orderly election; however, international observers considered it neither free nor fair. President Jammeh's party, the Alliance for Patriotic Reorientation and Construction (APRC), continued to dominate the political landscape, winning an overwhelming majority of national assembly seats in the parliamentary elections in 2012 and local assembly seats in local elections in 2013. Six of the seven opposition parties boycotted or otherwise did not participate in both the National Assembly and local government elections to protest government intervention and intimidation of opponents.Civilian authorities at times did not maintain effective control over the security forces. The regime responded with excessive force to peaceful public protests on April 14, April 16, and May 9. More than 70 supporters of the United Democratic Party (UDP) were arrested; several were beaten and tortured during the three protests. Thirty of the detainees were convicted on July 20 and July 21, and sentenced to three years' imprisonment. Two of the detainees died in custody.
