“Lineamenti di diritto penale del lavoro” si propone di fornire un’analisi degli aspetti e dei risvolti penali della vigente normativa in materia di sicurezza nei luoghi di lavoro, in particolare, concentrando il focus sul punto di vista dell’imprenditore–datore di lavoro. La disamina riguarderà, in primo luogo, la legislazione speciale in materia antinfortunistica, confluita nel Testo Unico in materia di sicurezza sul lavoro (decreto legislativo n. 81 del 2008), le singole ipotesi di responsabilità penale ivi previste, nonché i reati previsti dal codice penale, in secondo luogo, l’individuazione dei soggetti obbligati, titolari di una posizione di garanzia. Infine, spazio sarà dedicato all’analisi della responsabilità amministrativa degli enti derivante da reato ex decreto legislativo n. 231 del 2001, con precipuo riferimento alle ipotesi delittuose relative alla sicurezza sul lavoro.

A distanza di quasi dieci anni dalla sua emanazione la disciplina contenuta nel d.lgs. n. 81/2008, e successive modifiche ed integrazioni (c.d. Testo Unico sulla sicurezza del lavoro), pur mantenendo una stringente attualità, deve fare i conti con i mutamenti nel frattempo intervenuti. Nel periodo più recente gli interventi in materia di salute e sicurezza sul lavoro sono chiamati in particolare a confrontarsi con i temi della flessibilità del lavoro, dell’innalzamento dell’età lavorativa, della semplificazione normativa. Questione centrale è l’effettiva applicazione delle disposizioni in materia. A tal fine è richiesto un impegno costante, ed auspicabilmente coordinato, delle istituzioni e dei soggetti che da versanti diversi (responsabili aziendali, consulenti per la sicurezza, dirigenti e operatori sindacali) sono impegnati in tale delicato settore. Il volume si propone come introduzione allo studio del diritto della salute e della sicurezza sul lavoro, con particolare attenzione alle fonti ed ai principi regolativi della materia. Marco Lai è responsabile dell’area giuslavoristica del Centro Studi Nazionale Cisl di Firenze e professore a contratto di Diritto della sicurezza sul lavoro nell’Università di Firenze. «In questo isolato lembo dell’ordinamento giuridico, per decenni trascurato o addirittura ignorato, nell’erronea convinzione che si trattasse di materia priva di ogni rilevanza teorica e scientifica», come ha scritto il primo Maestro del diritto della sicurezza sul lavoro, si situano oggi i fondamenti principali, di rilievo costituzionale, di una nuova concezione del lavoro all’interno delle organizzazioni pubbliche e private. Una concezione che va oltre la gestione dei rischi professionali e pone al centro la persona, nella totalità dei suoi aspetti psico-fisici, relazionali e sociali, con una prospettiva aperta che coinvolge l’integrità e la sostenibilità dell’ambiente esterno. Del resto, l’utilizzo intenso delle tecnologie e le situazioni in cui l’attività umana è decontestualizzata e lontana dal luogo fisico indicano che occorre superare un’idea di salute e sicurezza incentrata sulle cose, e pensare invece alla persona. Il sistema regolativo della prevenzione è solo tendenzialmente definito e in equilibrio, siccome caratterizzato da un’accentuata dinamicità che impegna interpreti e operatori.
