This book explores the ways in which Muslim communities across the Indian Ocean world produced and shaped Islamic law and its texts, ideas and practices in their local, regional, imperial, national and transregional contexts. With a focus on the production and transmission of Islamic law in the Indian Ocean, the chapters in this book draw from and add to recent discourses on the legal histories and anthropologies of the Indian Ocean rim as well as to the conversations on global Islamic circulations. By doing so, this book argues for the importance of Islamic legal thoughts and practices of the so-called "peripheries" to the core and kernel of Islamic traditions and the urgency of addressing their long-existing role in the making of the historical and human experience of the religion. Islamic law was and is not merely brought to, but also produced in the Indian Ocean world through constant and critical engagements. The book takes a long-term and transregional perspective for a better understanding of the ways in which the oceanic Muslims have historically developed their religious, juridical and intellectual traditions and continue to shape their lives within the frameworks of their religion. This volume offers a fascinating case study of the Sayyid community of Cikoang in South Sulawesi – in particular, an examination of the role of the descendants of Sayyid Jalaluddin al-‘Aidid, a Hadhrami merchant-teacher of great authority and charisma who is said to have initially settled in Gowa in the 17th century. It is of particular interest because the migration of Sayydid Jalaluddin occurred well before the major Hadhrami diaspora to Southeast Asia in the mid-19th century. Of particular interest is the way Sayyid Jalaluddin and his descendants became integrated within the Makassar community. Sayyid Jalaluddin’s legacy to the Cikoang community is the Tarekat Bahr ul-Nur, whose mystic teachings expound the creation of the world from the ‘Nur Muhammad’. A consequence of this teaching is an enormous emphasis on the celebration of Maudu’ (Maulid or the Birth of the Prophet) as expressed in the local assertion: ‘My existence on this earth is for nothing but Maudu’.’ Every year this prompts the Cikoang community to hold one of the most elaborate and colourful Maulid celebrations in Indonesia. This study was originally submitted as an MA thesis at ANU in 1998, but soon became recognised as an important contribution to Hadhrami studies. Its author, M. Adlin Sila, has since gone on to complete his PhD at ANU, Being Muslim in Bima of Sumbawa, Indonesia: Practice, Politics and Cultural Diversity. This study of Bima and its religious history establishes him as a major researcher on the diverse traditions of Islam in eastern Indonesia.

With the entrance of the European Union into the field of International Investment Law and Arbitration, a new specialist field of law, namely ‘European Investment Law and Arbitration’ is in the making. This new field of law draws on EU Law, Public International Law, International Investment Law, International Arbitration Law and Practice and International Economic Law, while others fields of law such as Energy Law are also relevant. The European Investment Law and Arbitration Review is the first law periodical specifically dedicated to the field of ‘European Investment Law and Arbitration’. The timing could not be better. The first EU integrated investment treaties with Canada (CETA), US (TTIP) and Singapore (EU-SING) are either negotiated or about to be signed and ratified by the EU and its Member States. These are “integrated” investment treaties in that they combine free trade agreement provisions with international investment agreement norms. Moreover, the Court of Justice of the EU (CJEU) is about to deliver its first judgments and Opinions directly relating to intra-EU BITs and the EU-SING FTA. More generally, the public debate and discussions within academic and practitioner circles about the pros and cons of investor-state dispute settlement (ISDS) and investment treaties in general is intensifying almost on a daily basis. This is the first work available in any language to extensively document and critically discuss traditions of 'Alid piety and their modern contestations in the region. The concept of 'Alid piety allows for a reframing of our views on the widespread reverence for 'Ali, Fatima and their progeny that emphasizes how such sentiments and associated practices are seen as part of broad traditions shared by many Muslims, which might or might not have their origins in a specifically Shi'a identity. In doing so, it facilitates the movement of academic discussions out from under the shadow of polemical sectarian discourses on 'Shi'ism' in Southeast Asia. The chapters include presentations of new material from previously unpublished early manuscript sources from Muslim vernacular literatures in the Malay, Javanese, Sundanese, Acehnese and Bugis languages, as well as rich new ethnography from across the region. These studies engage with cultural, intellectual, and performative traditions, as well as the ways in which 'Alid piety has been transformed in relation to more strictly sectarian identifications since the Iranian revolution in 1979.

The Bugis Chronicle of Bone is a masterwork in the historiographical tradition of South Sulawesi in Indonesia. Written in the late seventeenth century for a very specific political purpose, it describes the steady growth of the kingdom of Bone from the fourteenth century onwards. The local conquests of the fifteenth century, closely linked to agricultural expansion, give way to the long conflict with the Makasar state of Gowa in the sixteenth century. Forced Islamisation in 1611 is dealt with in detail, leading finally to first contact with the Dutch East India Company in 1667. This edition presents a diplomatic version of the best Bugis text, together with the first full English translation and an extensive introduction covering the philological approach to the edition, as well as the historical and cultural significance of the work. A structure based on the reigns of successive rulers allows for stories about the circumstances of each ruler and, particularly, the often dramatic processes and politics of succession. The chronicle is a rich source for historians and anthropologists seeking to understand societies beyond Europe. It provides a window on to this Austronesian-speaking society before the impact of significant external influences. This is history from within, covering more than three centuries.
