Los problemas de conducta en la infancia y la adolescencia vienen generando en los últimos años una elevada inquietud en la sociedad provocando una atención cada vez mayor por parte de las autoridades. Las dificultades del sistema de protección de menores a la hora de intervenir ante situaciones conflictivas derivadas de problemas de comportamiento agresivo, inadaptación familiar o situaciones de violencia filioparental, entre otras, hacían imprescindible una nueva regulación basada en un enfoque de derechos de los niños y niñas. En ese contexto, la Ley Orgánica 8/2015, de 22 de julio, de modificación del sistema de protección a la infancia y a la adolescencia, incorporó un nuevo capítulo en la Ley Orgánica 1/1996, de 15 de enero, de Protección Jurídica del Menor, dedicado a los centros de protección específicos de menores con problemas de conducta, concibiéndolos como recursos especializados dentro de dicho sistema en los que la intervención socioeducativa y psicoterapéutica puede venir acompañada de medidas restrictivas de derechos fundamentales. La presente publicación trata, en definitiva, de contribuir al estudio y el análisis de este tipo de recursos residenciales especializados desde las tres principales perspectivas desde las que pueden ser contemplados: la jurídica, la psicosocial y la educativa. En dicho análisis se han tenido presentes las reformas introducidas por la Ley Orgánica 8/2021, de 4 de junio, de protección integral a la infancia y la adolescencia frente a la violencia, y se hace especial hincapié en la necesidad de que esta regulación se complemente con un adecuado desarrollo normativo, tanto estatal como autonómico.
