Como acertadamente refiere el Doctor Francisco José Infante Ruiz, quien se encarga de realizar el prólogo de esta obra, el presente libro coordinado por las profesoras Grisel Galiano Maritan y Teresa Delgado Vergara y, en el que participan una serie de abogados y profesores, trata del Derecho de contratos en el Código Civil de Ecuador. Pero no sólo eso, hay más. También se mueve en la encrucijada de un Derecho cambiante, que debe responder a una realidad social y económica muy diferente a la que conformó el Código civil de Ecuador en el siglo XIX, el cual casi no ha merecido la atención del legislador sobre este tema en sus sucesivas reformas. Estamos ante un Derecho elaborado técnicamente en el pasado, pero que debe adaptarse a las necesidades socio-económicas de nuestro tiempo. Esta labor la realizan con gran solvencia los autores y autoras del libro en cada uno los temas que tratan. Así, desde el contrato de compraventa (primer contrato) hasta la transacción (último contrato) el lector puede hacer un recorrido por todos los contratos civiles. El tratamiento de los temas es riguroso y cuidado, y en todos ellos se suministra una cuidada bibliografía, así como un catálogo de fuentes (referidas a otros Códigos Civiles del entorno jurídico ecuatoriano). Por ello, es posible decir que nos encontramos ante una actualización del Derecho ecuatoriano que camina ya en la senda de la “modernización” de esta rama del ordenamiento jurídico. El orden de la obra y su confección son clásicos, como no podía ser de otro modo en una obra dirigida al estudio de los contratos tal y como se contienen en el Código Civil. Sin embargo, el contenido de los temas no rehúye la realidad, sino todo lo contrario: plantea los problemas en su dimensión actual, tiene en cuenta la jurisprudencia y plantea las críticas necesarias. El libro propone una exhaustiva revisión de los principales tipos contractuales regulados en el vigente Código civil ecuatoriano. Constituye un esfuerzo de profesores de universidades cubanas y ecuatorianas quienes, a partir de un riguroso estudio, analizan a la luz de la más moderna doctrina civil, las principales figuras contractuales reguladas en la norma civil sustantiva, conforme a los requerimientos y necesidades que la modernización del Derecho de contratos supone.
