In the 1560's and the 1570’s, several authors outside of Spain recorded the text of an oath supposedly uttered by the Aragonese people when they received their king. While most modern historians doubt the authenticity of the oath, they agree that it has frequently served the purposes of political propaganda whenever an Aragonese patriot has wished to epitomize his nation’s tradition of resistance to tyranny. This book studies the oath "We, who are worth as much as you, take you as our king, provided that you preserve our laws and liberties, and if not, not" as an example of historiographical fiction which belongs to a complex of legal-historical legends about the origins of Aragon. El presente libro recoge la edición y estudio de los fueros medievales navarros más relevantes, por Roldán Jimeno Aranguren, profesor titular de Historia del Derecho de la Universidad Pública de Navarra. En 1234 moría sin descendencia Sancho VII el Fuerte de Navarra, último rey de la dinastía pirenaica. Accedió al trono el conde de Champaña, convertido en Teobaldo I de Navarra. Los nobles, ante la condición de extranjero del nuevo monarca, impulsaron el proyecto de redactar el que luego se ha venido denominando Fuero Antiguo o Fuero Viejo, finalizándolo para 1238. Este texto breve acabó integrado en el Fuero General de Navarra, escrito en romance navarro-aragonés. El Fuero General, parte central de esta obra, regula las instituciones de derecho público y privado a partir del derecho consuetudinario, y convivió con la fortaleza y vitalidad de los fueros municipales durante los siglos XIII y XIV y que también son examinados en esta obra: Pamplona, Estella, Tudela, la Novenera y Viguera-Val de Funes. Para cada texto, el autor realiza un estudio sobre su significación histórico-jurídica, relaciona los manuscritos y ediciones existentes, justifica la edición escogida y expone la bibliografía más relevante en la materia, lo que dota a esta obra de un gran rigor y solvencia científica. La obra transcribe la versión romance cuando la fuente está en esta lengua y opta por una traducción al castellano cuando su redacción era latina. En las traducciones el autor sigue las normas de las Comisiones Internacionales de Paleografía y Diplomática. El resultado es el de una obra que no pretende agotar el análisis sobre unas fuentes complejas, pero que sirve para introducir al lector en las peculiaridades de un reino con personalidad propia, más allá de la esfera de influencia de la corona castellano-leonesa.
