La empresa multinacional (em) aparece como producto del proceso de internacionalización del capital que plantea a los estados problemas que conciernen tanto a su soberanía como a las relaciones laborales. En el derecho del trabajo la em crea un nuevo tipo de relación obrero-patronal al aparecer el trabajador multinacional y al desaparecer la identificación entre empresario y dueño del capital. La internacionalización del capital demanda del sindicalismo una respuesta a nivel internacional. Se recomienda en consecuencia la incorporación por los estados de la teoría del grupo de empresa y la elaboración por la oit de un código de conducta coercitivo a nivel internacional para la actuación de la em.
