El texto que se presenta indaga sobre los problemas de delimitación de la conducta imprudente, desde las nociones y dificultades comunes hasta las propias de este ámbito de acción particular. La obra expone las confusiones y respuestas sobre las exigencias de imputación objetiva y subjetiva, con análisis dogmático y jurisprudencial. El objetivo principal es brindar claridad, pero también cuestionar la distinción meramente subjetiva entre dolo e imprudencia y aquella que recurre únicamente a un criterio normativo. La publicación reúne las principales conclusiones sostenidas en otros estudios breves de la autora y se avanza hacia la determinación de condiciones de imputación de la conducta imprudente y su noción desde un examen integral, que aúna a la ley principalmente su aplicación práctica. Así, se expondrá primero el problema general del injusto imprudente para luego examinar por separado las principales confusiones y decisiones de la determinación del deber de cuidado médico externo y las referidas a las exigencias subjetivas. A este respecto, se pretende establecer los requisitos subjetivos mínimos y terminar con el análisis de las condiciones imputación objetivas y subjetivas recepcionadas en la jurisprudencia nacional, desde los años ochenta, cuando comienza a tener relevancia la responsabilidad penal médica.
